These Terms of Use (the “Terms”) govern your access to and use of SuperX AI, including the websites at https://aicloud.superx.sg (including the model marketplace) and https://aicloud.superx.sg/ai-apps (the SuperX-AI application), our AI services and API, creative canvas and other content creation tools, AI applications, the public gallery (the “Gallery”), the Creator Program, and other products and services provided by SuperX (collectively, the “Services”).
The Services are provided by SUPERX AI PTE. LTD. (UEN 202508925H), a company incorporated in Singapore (“SuperX,” “we,” “us,” or “our”), which is your sole contracting party under these Terms.
You accept these Terms by ticking the acceptance box when you create an account, whether you register with an email address or through a third-party sign-in service, or, where no acceptance box is shown, by accessing or using the Services. If you do not agree to these Terms, you must not access or use the Services.
If you use the Services on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, “you” and “your” refer to both you and the relevant entity.
In these Terms, a “consumer” is an individual who uses the Services wholly or mainly for purposes outside their trade, business, craft, or profession, and a “Business User” is any user who is not a consumer.
Important: Section 31 contains a binding arbitration agreement and a waiver of class and representative actions. They do not apply to consumers in the European Union, the European Economic Area, or the United Kingdom, or where the law does not allow them. If you are a consumer, you keep all rights that the mandatory law of your country of residence gives you.

Terms of Use
2. Eligibility and Account Registration
You must be at least 18 years old, and have the legal capacity to enter into a binding contract, to create an account or use the Services. The Services are not directed to anyone under 18. We may ask you to confirm your age and may suspend or close any account that we reasonably believe is used by a person under 18. You must comply with all applicable laws when using the Services.
Certain Services may have additional age, eligibility, or geographic requirements, and some Services or models may not be available in your jurisdiction (see Sections 5 and 13).
You may be required to create an account to access certain features.
You agree to:
-
Provide accurate and complete information;
-
Keep your account information current;
-
Maintain the confidentiality of your account credentials;
-
Protect your API keys and authentication credentials;
-
Promptly notify us of unauthorized access;
-
Be responsible for all activity conducted through your account, except to the extent caused by SuperX's breach of these Terms.
You may not create an account using false information or impersonate another person or entity. You may not create multiple accounts to abuse free or promotional offers, or create a new account after we have suspended or terminated your account for a breach of these Terms, unless we agree.
Organization accounts. If you create or join an organization account, the organization is the account holder and is responsible for its members' use of the Services and for all charges incurred under the organization account. The organization's administrators may invite and remove members, manage API keys, credits, and billing, and configure settings that apply to members, such as data policies that restrict which AI model providers may receive prompts, logging and retention preferences, and spending limits. Administrators may be able to view usage records and content within the organization account. SuperX follows the settings configured by administrators and is not responsible for their choices.
12. API Services
If you use SuperX APIs:
API Keys
You are responsible for protecting your API keys and for all usage and charges incurred with them, except to the extent caused by our breach of these Terms.
You must not:
-
Publicly expose API keys;
-
Share API keys with unauthorized persons;
-
Use another person's API key without authorization;
-
Attempt to bypass API authentication or rate limits.
You must immediately revoke or rotate compromised API keys and notify us at support.ai@superx.sg.
API Usage
We may impose:
-
Rate limits;
-
Concurrency limits;
-
Quotas;
-
Model-specific restrictions;
-
Request-size limits;
-
Usage restrictions.
We may temporarily restrict or suspend API access where reasonably necessary to protect the Services or prevent abuse.
API Restrictions
Unless we give you our prior written authorization, you must not:
-
Resell, sublicense, or provide access to the API, your API keys, or your Credits to third parties as a stand-alone service (we give authorization for this only in a written reseller agreement signed by SuperX, which requires you to flow down the Export Compliance Terms, the Content and Community Policy and the applicable Provider Terms and to screen your customers);
-
Use the API to build or operate a model aggregation, routing, or API resale service that competes with the Services;
-
Send requests designed to extract model weights, parameters, or training data, or otherwise to reconstruct a model;
-
Publish the results of benchmark or performance tests of the Services, as opposed to the underlying models, without our prior written consent; or
-
Conceal the location or identity of the persons on whose behalf requests are made in order to evade the restrictions in Section 5.5 or Section 13.
You may use the API to power your own applications that add substantial functionality to it, provided that you comply with Section 5.2.
Red-Teaming and Security Testing
You must not conduct red-teaming, adversarial or jailbreak testing, safety evaluations designed to elicit prohibited content, penetration testing, or load testing of the Services or any model accessed through them, unless we have approved it in writing in advance or the testing is permitted by, and carried out in accordance with, our Vulnerability Disclosure Policy (https://aicloud.superx.sg/terms). Approved testing must follow the scope and conditions we set, and any prohibited content produced during testing must not be distributed. You may report security vulnerabilities in good faith under that Policy by email to security@superx.sg.
13. Export Controls and Sanctions
You must comply with the Export Compliance Terms (https://aicloud.superx.sg/terms), which are incorporated into these Terms and apply in addition to any other agreement you have with us. In particular:
-
You must not access or use the Services from, or for the benefit of any person located or ordinarily resident in, a Restricted Jurisdiction. Restricted Jurisdictions currently include Cuba, Iran, North Korea, Crimea, the so-called Donetsk and Luhansk People's Republics and other areas of Ukraine not under the control of the Ukrainian government, and any country we designate from time to time, currently Russia, Belarus, and Syria. The current list is set out in the Export Compliance Terms;
-
You represent that you are not a Restricted Party and are not owned 50% or more, individually or in the aggregate, by one or more Restricted Parties. Restricted Parties include persons on the sanctions or restricted-party lists of the United States (including the Specially Designated Nationals List, the Entity List, the Military End-User List, the Denied Persons List, and the Unverified List), the United Nations, the European Union, the United Kingdom, or Singapore, as further described in the Export Compliance Terms;
-
You must not use the Services for any end use prohibited by the Export Compliance Terms, including the development or production of weapons of mass destruction, restricted military or military-intelligence end uses, or surveillance or other human rights abuses;
-
You must not use a virtual private network, proxy, or other means to disguise your location or identity or to circumvent any geographic or access restriction.
We may screen accounts and transactions against restricted-party lists, ask for information to verify your identity, location, ownership, or intended use, and restrict or block access to the Services, or to particular models, from any jurisdiction at any time. We may suspend or terminate your account immediately and without liability if we reasonably believe that you have breached this Section 13 or the Export Compliance Terms, or if the law requires it. If we restrict the Services in your jurisdiction for reasons not caused by your breach, you may request a refund of your unused Purchased Credits, to the extent permitted by law.
Export Control and Sanctions Compliance Terms and Certification
EXPORT CONTROL AND SANCTIONS COMPLIANCE TERMS AND CERTIFICATION
Last Updated: September 28, 2026
By clicking “I Agree”, creating an account, or otherwise accessing or using any of the services provided by SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore (“SuperX”), including the SuperX AI model API, token, application and related services at https://aicloud.superx.sg and https://aicloud.superx.sg/ai-apps (collectively, the “Services”), you, on behalf of yourself and any entity you represent (together, “Customer”), agree to these Export Control and Sanctions Compliance Terms (the “Export Compliance Terms”) and give the certifications below.
These Export Compliance Terms form part of the SuperX AI Terms of Use (https://aicloud.superx.sg/terms) (the “Master Agreement”). They prevail over any conflicting provision of the Master Agreement or of any other document (including an Order Form), unless SuperX expressly agrees otherwise in a document signed by its authorized signatory that identifies the provision varied. SuperX is committed to complying with the export control and sanctions laws of Singapore, the United States and other applicable jurisdictions, and requires its customers to share that commitment.
In these Export Compliance Terms:
“Export Control and Sanctions Laws” means all export control, import and economic or trade sanctions laws and regulations that apply to Customer, SuperX or the Services, including the U.S. Export Administration Regulations (15 C.F.R. Parts 730–774) (the “EAR”), the U.S. International Traffic in Arms Regulations, sanctions administered by the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) and the U.S. Department of State, the Singapore Strategic Goods (Control) Act 2002, regulations made under the Singapore United Nations Act 2001, sanctions regulations issued by the Monetary Authority of Singapore, and the sanctions of the United Nations, the European Union and the United Kingdom, each as amended.
“Restricted Jurisdiction” means: (a) any country or region subject to comprehensive sanctions, currently Cuba, Iran, North Korea, the Crimea region of Ukraine, the so-called Donetsk People’s Republic and Luhansk People’s Republic, and any other area of Ukraine not under the control of the Government of Ukraine; and (b) any other country or region that SuperX designates from time to time, currently Russia, Belarus and Syria.
“Restricted Party” means any person or entity that: (a) is identified on, or acts on behalf of a person identified on, any restricted-party list maintained by the United States (including the Specially Designated Nationals and Blocked Persons List, the Entity List, the Military End-User List, the Denied Persons List and the Unverified List), the United Nations, the European Union, the United Kingdom or Singapore; (b) is owned 50% or more, directly or indirectly, individually or in the aggregate, by one or more persons described in paragraph (a); or (c) is the government of a Restricted Jurisdiction, or is located, organized or ordinarily resident in a Restricted Jurisdiction. As a matter of contract, and whether or not the law requires it, paragraph (b) applies to entities owned 50% or more by parties on the Entity List or the Military End-User List, including during any period in which the BIS “Affiliates Rule” is suspended or otherwise not in effect.
“Country Group D:5” means the countries listed in Country Group D:5 of Supplement No. 1 to Part 740 of the EAR, as amended.
Accordingly, Customer represents, warrants and undertakes to SuperX as follows, on acceptance and each time it uses the Services:
-
Ownership and Control: Customer is not owned or controlled, directly or indirectly, by: (a) the government or military of any Restricted Jurisdiction; (b) any military-industrial complex company, including any entity on the list maintained by the U.S. Department of Defense under Section 1260H of the National Defense Authorization Act for Fiscal Year 2021; or (c) any Restricted Party.
-
Transparency and Headquarters: Customer shall provide, at onboarding and on request, a complete and accurate description of its ownership structure, controlling persons and beneficial owners, and shall disclose the country in which Customer is headquartered and the country in which its ultimate parent is headquartered.
-
Intended Use: Customer shall use the Services solely for lawful purposes and shall not use them for any purpose prohibited by these Export Compliance Terms. On request, Customer shall accurately describe the intended end use of the Services and the location of its end users.
-
Prohibited End Uses: Customer shall not use the Services (including AI models and tokens) for or in connection with: (a) the design, development, production, stockpiling or use of nuclear, chemical or biological weapons, or of missiles or unmanned aerial vehicles capable of delivering them; (b) any military end use or military-intelligence end use described under “Military and Military-Intelligence End Users” below; (c) any advanced-computing or supercomputer end use restricted by 15 C.F.R. §744.23, including the development or production of supercomputers or advanced-node integrated circuits where that section applies; (d) surveillance, censorship or other activities that facilitate human-rights abuses; (e) training AI models for or on behalf of any party headquartered in Macau or any Country Group D:5 country where Customer knows or has reason to know that the model will be used for weapons-of-mass-destruction or military-intelligence end uses (see the BIS policy statement of May 13, 2025); (f) the use of any advanced-computing integrated circuit that BIS has identified as presumptively subject to General Prohibition 10 of the EAR; (g) any activity for or on behalf of a Restricted Party or the government or military of a Restricted Jurisdiction; or (h) any export, reexport, transfer or release of the Services, technology, model weights or output in violation of Export Control and Sanctions Laws.
-
No Resale or Third-Party Access: Customer shall not resell, sublicense or otherwise provide any third party with access to the Services (including access to AI models, API keys or tokens) without SuperX’s prior written consent and a written reseller agreement signed by SuperX, which requires flow-down of these Export Compliance Terms, KYC and screening of downstream users, geo-fencing and access controls, logs and audit rights. This does not prevent Customer from offering its own application to end users who receive only the application’s functionality (and not direct access to the Services, compute capacity, API keys or tokens), provided that the application’s primary purpose is not to resell compute capacity, model inference or tokens and that none of those end users is a Restricted Party or located in a Restricted Jurisdiction.
-
General Compliance: Customer shall comply in all respects with all Export Control and Sanctions Laws, and shall not engage in any activity that would cause SuperX to violate, or to face enforcement or sanctions action under, any Export Control and Sanctions Laws.
-
Restricted Parties: Customer is not a Restricted Party, is not acting on behalf of a Restricted Party, and shall not permit any Restricted Party to access or benefit from the Services.
-
Restricted Jurisdictions: Customer is not located, organized or ordinarily resident in any Restricted Jurisdiction, and is not owned 50% or more, or controlled, by any entity organized or located in, or any individual ordinarily resident in, a Restricted Jurisdiction. Customer shall not access or use the Services from, or for the benefit of any person in, a Restricted Jurisdiction, and shall not use a VPN, proxy or other means to disguise its location or to circumvent SuperX’s geo-blocking, IP-based restrictions or identity checks.
-
Military and Military-Intelligence End Users: Customer is not a “military end user”, and will not use the Services for a “military end use”, in or of any country to which 15 C.F.R. §744.21 applies, any other Country Group D:5 country or Macau (each term as defined in §744.21, as amended). Customer is not a “military-intelligence end user”, and will not use the Services for a “military-intelligence end use”, as defined in 15 C.F.R. §744.22, as amended.
-
Prohibited AI Systems: Customer shall not and does not intend to use the Services for the development of any AI system that is designed or intended to be used for any:
-
Military end use: (e.g., for weapons targeting, target identification, combat simulation, military vehicle or weapon control, military decision-making, weapons design (including chemical, biological, radiological, or nuclear weapons), or combat system logistics and maintenance); or
-
Government intelligence or mass-surveillance end use: (e.g., through incorporation of features such as mining text, audio, or video; image recognition; location tracking; or surreptitious listening devices).
-
Compute Threshold: Customer shall not, without SuperX’s prior written approval, use the Services to train any AI model using a quantity of computing power greater than the following thresholds, which are a SuperX contractual policy (Section 19.3A of the Services Agreement) and apply whether or not any law imposes a similar threshold:
-
10^25 computational operations (e.g., integer or floating-point operations); or
-
10^24 computational operations (e.g., integer or floating-point operations) using primarily biological sequence data.
-
Recordkeeping: Customer shall maintain complete and accurate records relating to its use of the Services (including records of end uses and, where resale or downstream access is authorized, of downstream users) for at least five (5) years, consistent with 15 C.F.R. Part 762, and shall provide reasonable cooperation to SuperX in connection with any export-control or sanctions inquiry, audit or regulatory request.
-
Supplier Requirements: Customer acknowledges that the hardware and software used to provide the Services are supplied to SuperX by its hardware and software suppliers (including manufacturers and distributors), subject to export-control and end-use conditions. Customer shall comply with any such requirements that SuperX notifies to Customer, and agrees that SuperX may provide information about Customer and its use of the Services (including end-use and end-user information) to those suppliers or to competent authorities where their conditions or the law require it, subject to SuperX’s confidentiality obligations and the applicable Privacy Policy.
-
Information, KYC and Audit: Customer shall provide, within fourteen (14) days of SuperX’s request (or sooner where required by law), any information and documentation that SuperX reasonably requests to verify compliance with these Export Compliance Terms, including KYC, beneficial-ownership and end-use information and end-use statements. On reasonable notice, SuperX (or an independent auditor bound by confidentiality) may audit Customer’s compliance with these Export Compliance Terms, including relevant records, and Customer shall cooperate.
-
Authority: The individual clicking “I Agree” or otherwise accepting these Export Compliance Terms is at least eighteen (18) years old and is duly authorized to accept them on behalf of Customer, and the information associated with Customer’s account is accurate and complete to the best of Customer’s knowledge and belief.
-
Duty to Update: Customer shall notify SuperX in writing at legal@superx.sg within five (5) business days if any statement in these Export Compliance Terms becomes inaccurate or misleading, or if there is any change in Customer’s ownership, control, headquarters, restricted-party status or intended end use that may have export-control or sanctions implications. Customer shall cooperate with any resulting compliance review and shall suspend use of the Services if required by law or if requested by SuperX for compliance reasons.
-
SuperX Rights: SuperX may screen Customer and its users against restricted-party lists at any time, and may refuse, suspend, restrict or terminate the Services, block access from any location, and withhold any transaction, immediately and without liability, where SuperX reasonably believes that Customer is in breach of these Export Compliance Terms or that providing the Services may violate Export Control and Sanctions Laws. SuperX may report suspected violations to competent authorities. Customer is not entitled to any refund for a suspension or termination resulting from its breach, except to the extent that applicable law requires a refund.
-
Change in Law: Customer acknowledges that the Export Control and Sanctions Laws applicable to advanced computing and AI are changing, including through legislation such as the U.S. Remote Access Security Act (H.R. 2683, passed by the U.S. House of Representatives on January 12, 2026 and pending in the Senate) and any final rule of the U.S. Bureau of Industry and Security on customer identification by infrastructure-as-a-service providers (proposed in January 2024 and not final as of the Last Updated date). SuperX may suspend, restrict or modify the Services, or require additional information or certifications, to comply with any new or amended law. Where such a change is not caused by Customer, SuperX shall refund any unused prepaid fees for the affected Services in accordance with the Payments, Credits and Refund Policy.
-
Precedence and Governing Law: These Export Compliance Terms prevail as stated above, survive termination of the Master Agreement, and are governed by the governing-law and dispute-resolution provisions of the Master Agreement.

3. Payment and Credits
Terms of Use
10. Credits and Usage
Paid Services are paid for with prepaid credits (“Credits”) held in your account. Credits may be purchased by you (“Purchased Credits”) or granted by us as a promotion (“Promotional Credits”). Credits are a prepaid right to use the Services. They are not money, electronic money, or a deposit, do not earn interest, cannot be transferred between accounts, and cannot be exchanged for cash except as set out in the Payments Policy.
10.1 Credit Usage
Credit consumption depends on factors including:
-
Model selected;
-
Input tokens;
-
Output tokens;
-
Image, video, or audio processing;
-
Compute resources;
-
API usage;
-
Other applicable service metrics.
Usage rates may vary between models and Services.
We display consumption rates for each model in the model marketplace (https://aicloud.superx.sg/model-plaza) or at the point of use, and your usage and remaining balance in your account.
10.2 Promotional Credits
Promotional Credits, vouchers, coupons, and other promotional benefits:
-
Expire on the date shown when they are granted;
-
May be subject to additional conditions;
-
Are not transferable;
-
Have no cash value and cannot be redeemed for cash;
-
Are not refundable, unless required by applicable law.
We may revoke promotional benefits obtained through fraud, abuse, technical errors, or violations of these Terms.
10.3 Changes to Pricing
We may change prices, consumption rates, quotas, or other charges from time to time, including when a Model Provider changes its prices.
New consumption rates apply to requests made after they are displayed in the model marketplace or at the point of use. Where required by applicable law, we will provide appropriate notice before material changes take effect.
11. Payments, Auto-Recharge and Refunds
Paid Services may require payment of applicable fees. The full payment terms, including refunds, Credit expiry, and auto-recharge, are set out in the Payments Policy (https://aicloud.superx.sg/terms), which is incorporated into these Terms.
You authorize SuperX or its payment service providers to process applicable charges.
In summary:
-
Prices are in US dollars, and fees are charged according to the pricing information presented at the time of purchase;
-
Prices exclude taxes unless stated otherwise; GST, VAT, or other taxes are added where applicable, and the total, including taxes, is shown before you pay;
-
You are responsible for applicable taxes associated with your purchases and for keeping your tax information accurate, and Business Users must gross up any withholding tax so that we receive the full amount;
-
Payment transactions are processed by third-party payment service providers, and only the payment methods shown at checkout are available;
-
You may request a refund of unused Purchased Credits within 14 days of purchase. After that, Purchased Credits are non-refundable, except where we terminate your account without cause, we discontinue the Services, you close your account (in which case we refund your unused Purchased Credits less a processing fee), or the law requires a refund, in each case as set out in the Payments Policy;
-
Purchased Credits expire 12 months after purchase, and Promotional Credits expire on the date shown when they are granted;
-
Auto-recharge is optional and off unless you turn it on. If you turn it on, we will charge your saved payment method the amount you choose each time your balance falls below the threshold you choose, until you turn it off in your billing settings, which you can do at any time. We send a receipt for every charge;
-
If you dispute a charge with your bank or card issuer instead of contacting us first, we may suspend your account while the dispute is resolved and recover the disputed amount if it is resolved in our favor, and Business Users must also reimburse our reasonable costs.
Refunds are available only as set out in the Payments Policy or as required by applicable law.
If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you have a legal right to withdraw from a purchase within 14 days. We will make purchased Credits available during that period only if you expressly ask us to at checkout and acknowledge that, if you withdraw, you must pay for the Credits you have already used. You can withdraw using the withdrawal function in your account, by email to support.ai@superx.sg, or with the model withdrawal form, as explained in Section 10 of the Payments Policy. Nothing in these Terms excludes any non-waivable consumer rights.

Introduction
This Payments, Credits and Refund Policy (this “Policy”) is issued by SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore with its registered office at 30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440 (“SuperX”, “we”, “us” or “our”). It explains how you pay for our services and how we handle charges, balances, credits, refunds and withdrawals on:
- SuperX AI, including the model marketplace, the API, AI applications, and the creative canvas and other content creation tools at https://aicloud.superx.sg, and the SuperX-AI app at https://aicloud.superx.sg/ai-apps (“SuperX AI”).
This Policy is published at https://aicloud.superx.sg/terms. It is incorporated into, and forms part of, the SuperX AI Terms of Use at https://aicloud.superx.sg/terms (the “SuperX AI Terms” or the “Main Terms”). Capitalized terms that are not defined in this Policy have the meanings given in the applicable Main Terms.
How this Policy is organized. Part A sets out terms that apply to payments. Part C applies to SuperX AI Credits. Part D explains how to contact us. If this Policy conflicts with the applicable Main Terms, the order of precedence set out in those Main Terms applies. A signed Order Form or enterprise agreement prevails over this Policy to the extent that it expressly says so.
Your statutory rights. Nothing in this Policy excludes or limits any right you have as a consumer that cannot be excluded or limited under the law that applies to you. Section 10 explains the right of withdrawal for consumers in the European Union, the European Economic Area and the United Kingdom. In this Policy, a “consumer” is an individual acting for purposes outside their trade, business, craft or profession, and a “business customer” is any other customer.
PART A – TERMS COMMON TO BOTH PLATFORMS
1. Prices and Currency
1.1 Currency. All prices are in United States dollars (USD) unless stated otherwise at checkout. If your card issuer or payment provider converts a charge into another currency, it may apply its own exchange rate and fees, which we do not control.
1.2 Where prices are shown. Prices and consumption rates for SuperX AI are shown in the model marketplace at https://aicloud.superx.sg/model-plaza, on the pricing page at https://aicloud.superx.sg/pricing, or at the point of use.
1.3 Price changes. We may change prices from time to time. A price change does not affect a purchase you have already completed, such as a Subscription term you have already paid for or Credits you have already bought. However, new consumption rates for SuperX AI models apply to requests made after they are displayed (Section 20). Where the Main Terms or the law require advance notice of a price change, we will give it.
2. Taxes
2.1 Prices exclude tax. Prices exclude taxes unless stated otherwise. We add goods and services tax (GST), value-added tax (VAT), sales tax or similar taxes where we are required to charge them, based on the tax information in your account. Before you complete a purchase, the checkout shows the total amount payable, including any taxes.
2.2 Tax settings. You must complete your tax settings, including your country of residence or establishment and, for a business, any tax registration number, before your first purchase, and keep them accurate. If you give us a valid business tax registration number, a reverse-charge or other special tax treatment may apply, and you are then responsible for accounting for the relevant tax.
2.3 Business customers. If you are a business customer, you are responsible for all taxes, duties and levies relating to your purchases, other than taxes on SuperX’s net income. If you are required by law to withhold or deduct any tax from a payment to us, you must increase the payment so that we receive the full amount we would have received without the withholding or deduction, and you must give us the official receipt for the tax withheld.
2.4 Inaccurate information. To the extent permitted by law, you are responsible for any additional tax, interest or penalty that results from inaccurate tax information you provide.
3. Payment Methods
3.1 Cards. We accept payment by card using the payment methods shown at checkout. Card and other payment details are collected and processed directly by our third-party payment service providers. We do not receive or store full card numbers or security codes. Our payment service providers’ own terms and privacy notices may also apply.
3.2 Other methods. We accept other payment methods, such as bank transfer for invoiced business customers, only if they are shown at checkout or agreed with us in writing.
3.3 Additional terms. Other payment methods, if shown at checkout, may be subject to additional terms shown there, which apply if you use them.
3.4 Authorized use. You must only use a payment method that you are authorized to use.
4. Authorizations and Failed Payments
4.1 Your authorization. You authorize us and our payment service providers to charge your payment method for: (a) purchases you make at checkout; (b) amounts owed under the Main Terms, such as charges for usage; and (c) if you turn them on, auto-recharge (Section 23) and automatic renewal (Section 13.3).
4.2 Temporary holds. When you add a payment method or make a purchase, a temporary authorization may be placed on your payment method to check that it is valid. Your bank may show it as pending until it is released.
4.3 Failed payments. If a payment fails or is declined, we may retry it, ask you to update your payment method, and withhold or suspend the purchase or feature concerned until payment is made.
5. Billing Questions, Disputes and Chargebacks
5.1 Contact us first. If you think a charge is wrong, please contact us using the details in Part D. We will look into billing questions in good faith and correct any error we find. Invoiced business customers must raise any dispute about an invoice in writing within 14 days of receiving it, with reasonable supporting detail, and must pay any undisputed amount by the due date.
5.2 Chargebacks. If you ask your bank or card issuer to reverse a payment (a chargeback), or otherwise dispute a payment with your payment provider, we may suspend your account or the affected services while the dispute is pending. If the dispute is resolved in our favor, the amount remains payable and we may recover it, including from your account balance. Business customers must also reimburse our reasonable chargeback fees and collection costs. We may close accounts that are the subject of repeated or abusive chargebacks.
5.3 Your rights. This Section does not limit any right you have under card scheme rules or under the law to dispute an unauthorized or incorrect payment.
6. Fraud Prevention and Compliance Checks
6.1 Checks. We and our payment service providers use automated and manual checks to detect and prevent fraud, and we may ask you to verify your identity, billing address or payment method (for example, through additional authentication with your card issuer) before we accept a payment.
6.2 Refusals and holds. We may refuse, cancel or hold any order, top-up, purchase of Credits, refund or withdrawal, and may suspend the account concerned, if we reasonably suspect fraud, unauthorized use of a payment method, money laundering, terrorist financing, sanctions evasion or other unlawful activity, or where the law requires it. We may report suspected unlawful activity to the competent authorities, and the law may prohibit us from telling you that we have done so.
7. Promotions, Vouchers and Bonus Credits
7.1 Promotions. We may offer vouchers, coupons, bonus credits, trial credits or other promotional benefits (“Promotional Credits”). Each promotion may have its own conditions, which we will show when you receive or redeem it.
7.2 Rules. Unless the promotion states otherwise, Promotional Credits: (a) have no cash value and cannot be refunded, withdrawn or exchanged for cash; (b) cannot be transferred and can be used only in the account to which they were issued; (c) expire on the date shown when they are issued; (d) may be limited to particular services, models, resources or billing methods; and (e) are used in the order shown in your account or at checkout, but are treated as used before Purchased Credits and paid balance when we calculate any refund or withdrawal.
7.3 Abuse. We may cancel or reclaim Promotional Credits, and suspend services obtained with them, if they were obtained or used through fraud, abuse (including by creating multiple accounts) or error, or in breach of the Main Terms or the conditions of the promotion.
7.4 Not refundable. Any part of an order that is paid with Promotional Credits or vouchers is not refundable.
8. Receipts, Invoices and Statements
8.1 We provide an electronic receipt for each card payment, for example by email or in your account. Invoices are available on request by email to finance.ai@superx.sg. Receipts and invoices show any taxes charged, as required by law.
9. Your Balance and Credits Are Not Money
9.1 Your SuperX AI Credits are prepaid rights to use our services. They are not a bank deposit, electronic money or a payment account, they do not earn interest, and they are not protected by any deposit insurance scheme.
9.2 Balances and Credits cannot be transferred between accounts, sold or exchanged for cash, except through the refunds and withdrawals expressly provided for in this Policy or required by law.
9.3 We may apply your balance or Credits against amounts you owe us under the Main Terms.
10. Consumer Rights and Right of Withdrawal
10.1 Right of withdrawal. If you are a consumer habitually resident in the European Union, the European Economic Area or the United Kingdom, you may withdraw from a purchase of digital services from us, including a top-up, a Subscription order or a purchase of Credits, within 14 days after the contract is concluded, without giving any reason. To withdraw, tell us clearly before the 14-day period ends. You can use the “Withdraw from contract here” function in your account, which is available throughout the withdrawal period, email support.ai@superx.sg, or use the model withdrawal form that we provide with your order confirmation. When you use the withdrawal function, we will acknowledge receipt of your withdrawal by email without undue delay.
10.2 Immediate performance. At checkout, we will ask you to request expressly that we start providing the services immediately, during the withdrawal period, and to acknowledge that: (a) if you withdraw, you must pay for the services provided before you told us that you are withdrawing; and (b) you will lose your right of withdrawal once the services have been fully provided. If you do not make that request, we will not start providing the services until the withdrawal period has ended.
10.3 Refund on withdrawal. If you withdraw, we will refund the amount you paid, less a proportionate amount for the services provided up to the time you told us, within 14 days after we receive your notice. The proportionate amount is calculated on the basis of the total price you agreed to pay. For SuperX AI, it is the value of the Purchased Credits you have used. The voucher exclusion and duration-based discount adjustment in Section 14 do not reduce a refund below the amount required by this Section 10.3. We will refund you using the payment method you used for the original transaction, unless you expressly agree otherwise, and we will not charge you any fee for the refund.
10.4 Other consumer rights. If a paid service is not provided as described, or is not of the quality required by law, you may be entitled to remedies such as having the problem fixed, a price reduction or a refund under the consumer law that applies to you. Consumers in Singapore also have rights under the Consumer Protection (Fair Trading) Act 2003.
10.5 Business customers. The right of withdrawal in this Section 10 does not apply to business customers.
11. Changes to this Policy and Governing Law
11.1 Changes. We may update this Policy from time to time and will post the updated Policy with a new “Last Updated” date. If a change is material and adverse to existing customers, we will notify them by email, in the Console or in their account at least 15 days before it takes effect, unless the change is required by law or for security or fraud-prevention reasons. Changes do not affect purchases completed before the change takes effect.
11.2 Governing law and disputes. This Policy is governed by the laws of Singapore, and disputes are resolved under the dispute-resolution provisions of the applicable Main Terms.
PART C – SUPERX AI CREDITS
This Part C applies to SuperX AI, including the model marketplace, the API, AI applications and content creation tools.
19. Purchasing Credits
19.1 Credits. Paid features of SuperX AI are paid for with prepaid credits (“Credits”). Credits that you buy are “Purchased Credits”, and Credits that we give you under a promotion are Promotional Credits. Credits are denominated in USD or in credit units, as shown when you buy them.
19.2 Buying Credits. You buy Purchased Credits in the billing settings of your account. Your purchase is complete, and the Credits are added to your balance, when the payment is successful. Any minimum or maximum purchase amounts are shown in your billing settings or at checkout.
19.3 Using Credits. Credits can be used with any model or feature that accepts Credits, subject to the SuperX AI Terms, including any restrictions on particular models.
20. How Credits Are Consumed
20.1 Rates. Credits are consumed at the rates shown for each model in the model marketplace (for example, per million input and output tokens, or per image or per second of video or audio) or at the point of use in AI applications before you start a task. The rate that applies is the rate displayed when the request is made.
20.2 Multi-step tasks. Some tasks, such as agent workflows and video generation, consume Credits in several steps. Where we show an estimate, actual consumption may differ from it.
20.3 Failed requests. We do not charge Credits for a request that fails because of an error on our side or on the Model Provider’s side. If you cancel a request after processing has started, Credits may be charged for the processing already completed.
20.4 Order of use. Credits are used in the order shown in your account. For refunds, Promotional Credits are treated as used first (Section 7.2(e)).
20.5 Usage records. Your usage and remaining balance are shown in your account. If you believe that Credits were consumed in error, please contact us within 30 days.
21. Refunds of Credits
21.1 14-day refund. You may ask for a refund of the unused Purchased Credits from a purchase within 14 days of that purchase, by contacting support.ai@superx.sg or, where available, through your billing settings. We refund the unused Purchased Credits from that purchase to the original payment method. Credits that have already been used are not refunded. For consumers in the EU, the EEA and the UK, this refund also gives effect to the right of withdrawal in Section 10.
21.2 After 14 days. After the 14-day period, Purchased Credits are non-refundable, except where: (a) we terminate your account or the SuperX AI Terms without cause, that is, other than for your breach; (b) we discontinue SuperX AI, or stop offering it in your jurisdiction, for reasons not caused by your breach; (c) you close your account, in which case Section 25.2 applies; (d) you close your account under Section 25.3 because you do not accept a material adverse change, or, if you are a consumer in the EU or the EEA, you end the SuperX AI Terms because we changed the Services in a way that negatively affects you (Section 26 of the SuperX AI Terms); or (e) applicable law requires a refund. In those cases, we refund your unused Purchased Credits to the original payment method or, if that is not possible, to a bank account in the same name as the verified account holder.
21.3 Identifying unused Credits. For refunds, Purchased Credits are treated as used in the order in which they were purchased, so the refundable amount from a purchase is the amount purchased less the Credits used from it.
21.4 Promotional Credits. Promotional Credits are never refundable.
21.5 Conditions. Refunds are subject to Section 6, and we may refuse to refund Credits that were obtained through fraud or that are the subject of a chargeback. Refunds are made in USD, and we are not responsible for exchange-rate differences or fees charged by your bank or card issuer.
22. Expiry of Credits
22.1 Purchased Credits. Purchased Credits expire 12 months after the date of purchase. We may remind you by email before Purchased Credits expire. Expired Purchased Credits cannot be used or refunded, except where the law requires otherwise.
22.2 Promotional Credits. Promotional Credits expire on the date shown when they are issued.
23. Auto-Recharge
23.1 Optional. Auto-recharge is optional and off unless you turn it on. You can turn it on in your billing settings by choosing: (a) a threshold balance; (b) the amount of Credits to buy each time your balance falls below the threshold; and (c) the payment method to be charged. Where available, you can also set a monthly limit.
23.2 Clear terms and your consent. Before you turn on auto-recharge, we show you the threshold, the recharge amount and any applicable tax, the payment method, and how to cancel, and we ask for your consent. By turning auto-recharge on, you authorize us to charge that payment method the recharge amount, plus any applicable tax, each time your Credit balance falls below the threshold, until you turn auto-recharge off. We will send you an email setting out these terms and how to cancel.
23.3 Receipts. We send a receipt for every auto-recharge charge.
23.4 Cancel at any time. You can turn off auto-recharge at any time in your billing settings, with effect for future charges, or by contacting support.ai@superx.sg. Turning it off does not affect charges already made, but the 14-day refund in Section 21.1 applies to each auto-recharge purchase.
23.5 Failed charges and changes. If an auto-recharge charge fails, we may pause auto-recharge and will tell you. If we change the auto-recharge terms, we will notify you in advance, and the change will not apply to you until you have had an opportunity to turn auto-recharge off.
23.6 Safeguards. To protect you against unexpected usage, we may limit the number or total amount of auto-recharges in a given period.
24. Organization Accounts
24.1 Billing. For an organization account, the organization is the account holder and is responsible for all charges incurred by its members and through its API keys. Credits purchased by an organization belong to the organization and are available to its members as set by its administrators, who may be able to set spending limits for members or API keys.
24.2 Separate balances. Credits cannot be moved between personal accounts and organization accounts, or between organizations. If a member leaves the organization, the Credits remain with the organization.
24.3 Invoices and enterprise terms. Receipts and invoices for an organization account are issued in the organization’s name, using its tax details. If a signed enterprise agreement provides for invoicing, Sections 16.2 and 16.3 apply to it, subject to any changes set out in that agreement.
25. Account Closure and Termination
25.1 Closing your account. You may close your SuperX AI account at any time. Within 14 days of a purchase, you may ask for a refund of the unused Purchased Credits from that purchase under Section 21.1.
25.2 Remaining Purchased Credits. If you close your account, we refund your unused Purchased Credits, less a processing fee of 4% of the unused amount plus USD 0.50, which covers our payment-processing costs. For example, if USD 50 of Purchased Credits is unused, the fee is USD 2.50 and we refund USD 47.50. If the fee would equal or exceed the unused amount, no refund is due. The processing fee applies only to refunds under this Section 25.2. No fee is charged on any other refund of Purchased Credits, including under Sections 10, 21.1, 21.2(a), (b), (d) and (e), 25.3 and 25.4, or where the law does not allow one. Refunds are subject to Section 6 and are paid to the original payment method or, if that is not possible, to a bank account in the same name as the verified account holder. Promotional Credits are not refunded.
25.3 Objection to changes. If you close your account before a material adverse change to the SuperX AI Terms or this Policy takes effect, because you do not accept the change, we will refund your unused Purchased Credits.
25.4 Termination without cause or discontinuation. If we terminate your account without cause, discontinue SuperX AI, or stop offering it in your jurisdiction for reasons not caused by your breach, we will refund your unused Purchased Credits under Section 21.2.
25.5 Termination for breach. If we terminate your account because of your serious breach of the SuperX AI Terms, unused Purchased Credits lapse, except to the extent that the law requires a refund. Promotional Credits lapse on any closure or termination.

4. Model Terms
Terms of Use
5. Model Providers and Model Terms
The model marketplace and other Services give you access to AI models developed by third parties (“Model Providers”). Depending on the model, SuperX either hosts the model on infrastructure operated by or for SuperX, or sends your request to the Model Provider's own service, or to another hosting provider, through its API. The Model Terms identify, for each model, the Model Provider, how the model is hosted, where requests are processed, the provider terms and licenses that apply, and the provider's data retention and training practices as disclosed to us.
We also use other third-party providers, such as cloud, storage, authentication, payment, and analytics providers, to operate the Services. They are described in our Privacy Policy and our Sub-processor List (https://aicloud.superx.sg/privacy).
When you use a third-party model or service through SuperX:
-
Your request and relevant User Content may be transmitted to the applicable provider, which may process it in the location shown in the Model Terms, which may be outside your country;
-
The provider may process such information to fulfill your request;
-
The provider may impose additional terms or usage restrictions;
-
The provider's availability may affect the availability of the corresponding SuperX Service.
5.1 Provider Terms
You must comply with the terms of use, acceptable use policies, and licenses that apply to each model you use, as listed in the Model Terms (the “Provider Terms”). If the Provider Terms for a model are more restrictive than these Terms, the more restrictive provision applies to your use of that model. Some open-weight model licenses also require attribution or license notices or restrict certain uses, and you must comply with them.
5.2 Your Users
If you make the Services or Generated Content available to your own end users, for example through an application built on our API, you must bind them to terms that are at least as protective of SuperX and the Model Providers as these Terms, the Content and Community Policy, and the applicable Provider Terms, and you are responsible for their compliance.
5.3 Changes to Models
Model Providers may change, update, deprecate, or withdraw their models, or change their terms or prices, sometimes at short notice. We may therefore add, change, or remove models, or change the model version or provider behind a model name, subject to Section 5.4 and, if you are a Business User that has entered into the DPA, to the notice requirements of the DPA. We will try to give advance notice in the model marketplace or by email where practicable, but we are not liable for changes made by Model Providers.
5.4 Routing and Fallback
Each request goes to the model you select and is served in the hosting mode and processing location shown for that model in the Model Terms. Where a model is offered by more than one provider, in more than one hosting mode or in more than one location, your request goes only to an option that your data policies permit. If your data policies do not choose between the options, we use the SuperX-hosted option where there is one and otherwise the option shown for that model in the model marketplace when you select it. If we offer automatic routing and fallback (sending a request to another provider or endpoint, for example when the one selected is unavailable), they are off unless you, or your organization's administrator, turn them on. Even when they are on, we never move a request to a different hosting mode (for example, from a SuperX-hosted model to a provider's API) or to a processing location in a different country unless you have expressly allowed this in your settings. Routing and fallback always respect the data policies set for your account, such as restrictions on providers that retain prompts or that process data in particular countries. If no eligible option is available, the request will fail rather than be routed against your data policy.
5.5 Restricted Models
Some models are unavailable, or available only on conditions, in certain regions or to certain users or entities, because of Provider Terms, export control or sanctions laws, data protection laws, or our own policies (“Restricted Models”). You must not use a virtual private network, proxy, or other means to access a Restricted Model from a region where it is not available, or misrepresent your location or identity to do so. For users in the European Economic Area, the United Kingdom, and Switzerland, we may restrict models whose processing takes place in a country without an adequate level of data protection unless appropriate safeguards are in place.
5.6 Suspension of Model Access
We may suspend or restrict your access to a particular model, with or without notice, if the Model Provider requires us to do so, if the law requires it, or if we reasonably believe your use breaches the Provider Terms. Where practicable, we will tell you the reason. Your unused Purchased Credits remain available for use with other models.
5.7 Output Restrictions
Some Provider Terms restrict how outputs may be used, for example by prohibiting the use of outputs to develop or train models that compete with the provider's models (sometimes called distillation), by requiring attribution, or by restricting use in particular fields. Where the Model Terms identify such restrictions, you must comply with them.
5.8 Responsibility for Model Providers
SuperX does not control Model Providers. Except as expressly stated in these Terms, SuperX is not responsible for Model Providers' models, outputs, independent practices, policies, availability, or performance, including their handling of data beyond what we disclose in the Model Terms. We will take reasonable steps to keep the Model Terms accurate and up to date.

Introduction
These Model Terms and Provider Disclosures (the “Model Terms”) are issued by SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore with its registered office at 30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440 (“SuperX”, “we”, “us” or “our”).
They apply whenever you use an AI model through SuperX AI, including the model marketplace (https://aicloud.superx.sg/model-plaza), the SuperX AI API, AI applications and the SuperX-AI app at aicloud.superx.sg/ai-apps. They form part of the SuperX AI Terms of Use (https://aicloud.superx.sg/terms). In these Model Terms, the “Master Agreement” means the Terms of Use.
These Model Terms explain how your requests reach a model, where each model runs, whose terms apply to it and what happens to your data. Please read them together with our Privacy Policy (https://aicloud.superx.sg/privacy). Business customers should also read the Data Processing Agreement (https://aicloud.superx.sg/privacy).
1. Definitions and relationship to other terms
1.1 In these Model Terms:
-
“Model” means an AI model, such as a large language, image, video or audio model, made available through SuperX AI.
-
“Provider” means the developer or operator of a Model identified in the Disclosure Table.
-
“Provider Terms” means the Provider’s terms of service, usage or acceptable use policy, model license and other terms identified for a Model in the Disclosure Table, as the Provider updates them from time to time.
-
“Disclosure Table” means the information that SuperX publishes for each Model, on this page or on the Model’s page in the Services (which then forms part of this page), as described in Section 6: the Provider and its contracting entity, the hosting mode (SuperX-hosted or Provider API), the processing location (a country, or “Global”), the applicable Provider Terms and license, any output limits, whether the Provider is a third-party beneficiary (Section 4.2), the Provider’s retention of data received through SuperX and whether it uses that data for training, and whether a zero-retention option is available.
-
“Inputs” means prompts, instructions, files and other content you submit to a Model. “Outputs” means content a Model generates in response.
-
“SuperX-hosted” and “Provider API” mean the hosting modes described in Section 3.
Capitalized terms that are not defined here have the meanings given in the Master Agreement.
1.2 These Model Terms apply in addition to the Master Agreement and to:
-
for SuperX AI, the Content and Community Policy (https://aicloud.superx.sg/terms);
-
the Export Compliance Terms (https://aicloud.superx.sg/terms).
The order of precedence in the Master Agreement applies. Where Provider Terms or applicable law impose a stricter rule for a particular Model, that stricter rule also applies to your use of that Model. These Model Terms are governed by the laws of Singapore and the dispute resolution provisions of the Master Agreement.
1.3 SuperX can only grant you the rights it has. The Master Agreement and these Model Terms give you no right in a Model, its weights or its Provider’s technology beyond the right to use the Model through SuperX as the Provider Terms permit.
2. How routing works
2.1 You choose the Model. Each request goes to the Model you select, either by its model identifier in the API or in the model selector in the product. Each Model’s Provider and hosting mode are shown in the Disclosure Table, and its price is shown in the model marketplace or at the point of use.
2.2 Automatic routing and fallback (optional). If SuperX offers automatic routing and fallback, they are off unless you, or your organization’s administrators, turn them on. When they are on, SuperX may send a request to another endpoint serving the same Model or, if you have chosen automatic model selection, to another Model, for example when the Model you selected is unavailable, rate-limited or at capacity. Automatic routing and fallback only use Models, Providers, hosting modes and processing locations that your Custom Data Policies permit. They never move a request to a different hosting mode (for example, from SuperX-hosted to Provider API) or to a processing location in a different country unless you have expressly allowed this in your settings. If no permitted endpoint is available, the request fails.
2.3 Custom Data Policies. You can use Custom Data Policies to restrict which Providers, hosting modes or processing locations may receive your prompts. For an organization account, its administrators set them. For example, depending on the settings available, you may be able to allow only SuperX-hosted Models or exclude particular Providers or countries. If your Custom Data Policies do not choose between the hosting modes or locations offered for a Model, SuperX uses the SuperX-hosted mode where available and otherwise the option shown for that Model in the model marketplace when you select it. If no permitted Model is available for a request, the request fails rather than being sent elsewhere. Custom Data Policies set by an organization’s administrators apply to all its members.
2.4 Versions. A Provider may update the Model behind a model identifier. Where SuperX offers dated or pinned versions, you may select one to keep behavior stable.
2.5 Records. Where available, your usage records identify the Model and hosting mode that served each request.
3. Hosting modes
Each Model is offered in one or both of the following hosting modes. The Disclosure Table shows the mode or modes used for each Model.
3.1 SuperX-hosted. The Model is an open-weight model that SuperX runs on infrastructure operated by or for SuperX. Your Inputs and Outputs are processed within SuperX’s infrastructure and are not sent to the Model’s developer. The developer’s license for the open-weight model still governs how the Model may be used and, where the license says so, how its Outputs may be used.
3.2 Provider API. SuperX forwards your request to the Provider’s systems. The request includes your Inputs, the settings you choose and the technical metadata needed to process it. The Provider generates the Output and returns it to you through SuperX. The Provider processes the request under its own Provider Terms and privacy practices, in the locations it uses. These may include countries outside your own. SuperX’s agreement with the Provider governs what the Provider may do with your data, to the extent described in the Disclosure Table.
3.3 In both modes, SuperX processes Inputs and Outputs to provide the service, bill you, keep the service secure and detect and prevent abuse, as described in the Master Agreement and our Privacy Policy. SuperX does not use your Inputs or Outputs to train or improve AI models unless you opt in. Automated safety systems may screen Inputs and Outputs. Requests may be blocked, or Outputs withheld, where they appear to breach our terms or the Provider Terms.
4. Provider Terms and flow-down rules
4.1 Compliance with Provider Terms. When you use a Model, you must comply with its Provider Terms, including the Provider’s usage policy and model license, as well as the Master Agreement. Where the Provider Terms are stricter than our terms, the Provider Terms apply to that Model. Links to the Provider Terms are in the Disclosure Table.
4.2 Third-party beneficiaries. A Provider is an intended third-party beneficiary of this Section 4, as it applies to that Provider’s Model, only where its terms require this and the Disclosure Table says so. That Provider may then enforce this Section 4 directly against you. Otherwise, Providers have no rights under the Master Agreement or these Model Terms, including under the Contracts (Rights of Third Parties) Act 2001 of Singapore.
4.3 Provider changes. Providers may change their terms, prices, capabilities, safety filters, availability or processing locations at any time. SuperX will update the Disclosure Table to reflect material changes. Changes imposed by a Provider or required by law may apply immediately. If you are a business customer that has entered into the Data Processing Agreement, SuperX will not replace the Provider behind a Model you have used in the preceding 90 days, or change its hosting mode, without the notice required by Section 4.3 of that agreement (where such a change is required by law or for security reasons, SuperX may instead suspend the Model). SuperX will update the Disclosure Table within a reasonable time after it becomes aware of a material change to a Provider’s processing locations or practices.
4.4 Deprecation and withdrawal. A Model may be deprecated or withdrawn by its Provider or by SuperX. Where practicable, SuperX will give at least 15 days’ notice of a planned withdrawal that SuperX initiates. SuperX may suspend or withdraw a Model immediately where required by law, sanctions or export controls, for security reasons, or because the Provider has stopped or restricted supply. Unused credits remain available for other Models. Refunds are available only as set out in the Payments, Credits and Refund Policy (https://aicloud.superx.sg/terms) or as required by law.
4.5 Restricted Models. Some Models may be unavailable, or available only on conditions, in certain countries or regions, for certain types of entity or for certain uses. Reasons include Provider Terms, sanctions and export controls, local law or our own risk assessment. SuperX may require additional verification or prior approval, for example for organization accounts, high-volume use or security testing (including red-teaming). SuperX may restrict any Model at any time.
4.6 No circumvention. You must not circumvent Model restrictions, safety systems, rate limits or Custom Data Policies. This includes using VPNs or proxies to disguise your location, giving false location or entity information, using another person’s account or API keys, and reselling or sharing access. You must not jailbreak or otherwise manipulate a Model to produce content that our terms or the Provider Terms prohibit.
4.7 Output restrictions. Some Provider Terms restrict how Outputs may be used, for example by prohibiting their use to develop or train models that compete with the Provider’s models (“distillation”). Where they do, you must comply with those restrictions. The Disclosure Table notes known restrictions. Whatever the Provider Terms say, you must not use SuperX to extract Model weights, reverse engineer a Model, or systematically harvest Outputs to replicate a Model, unless the Model’s license and our terms expressly permit it.
4.8 Attribution and license notices. Some open-weight licenses impose attribution, naming, notice or similar requirements, which may depend on how, or how widely, you use the Model or its Outputs. If your use of a Model or its Outputs triggers such a requirement, you must comply with it. You must not state or imply that a Provider endorses your product, or present a Model as your own.
4.9 Labels and watermarks. Some Providers add visible or invisible labels, watermarks or metadata to Outputs, including where the laws that apply to them require it. SuperX may also apply them (see the Content and Community Policy). You must not remove, alter or obscure them.
4.10 Provider enforcement. A Provider may refuse requests or filter Outputs. It may also require SuperX to suspend access to its Model for an account that breaches its Provider Terms. SuperX may share with a Provider the information reasonably necessary to investigate or address a suspected breach of its Provider Terms, as described in our Privacy Policy.
4.11 Regulated and high-risk uses. You are responsible for any obligations that apply to how you deploy a Model or its Outputs. These include obligations under the EU Artificial Intelligence Act where you place an AI system on the market, or use it, in the European Union. You must not use a Model for any practice prohibited by that Act. You must not use a Model for a high-risk purpose without the assessments, safeguards and human oversight the law requires.
5. Data practices
5.1 Per-Model disclosure. For each Model, the Disclosure Table shows the Provider, hosting mode, processing location and applicable Provider Terms. It also shows the Provider’s retention and training practices for data received through SuperX.
5.2 Provider retention and training. For Provider API Models, the Provider may retain Inputs and Outputs for a limited period, as shown in the Disclosure Table, for example for abuse monitoring or to meet legal obligations. Where a Provider offers options not to train on, or not to retain, data received through SuperX, SuperX will use commercially reasonable efforts to turn them on. If a Provider may use data received through SuperX to train or improve its models, the Disclosure Table will say so.
5.3 SuperX retention. SuperX retains Inputs and Outputs as described in our Privacy Policy and, for business customers, the Data Processing Agreement. Content you save in projects, canvases or history is stored until you delete it or your account ends. If SuperX offers prompt logging for API requests, it is off unless you opt in. Where zero-data-retention settings are offered, they limit routing to endpoints that do not store Inputs or Outputs after processing, subject to legal and abuse-prevention exceptions.
5.4 Roles. For individual users of SuperX AI, SuperX is the controller of personal data in Inputs and Outputs. For business customers, SuperX processes that data as a processor under the Data Processing Agreement. Providers that receive data through a Provider API process it for SuperX, as SuperX’s sub-processors for business customers and as its service providers for individual users, except to the extent that the Disclosure Table states that a Provider may use data received through SuperX for its own purposes, such as training its models. Providers are included, as a category of sub-processor, in the Sub-processor List (https://aicloud.superx.sg/privacy). Business customers must not use a Model whose Provider may use data for its own purposes to process personal data covered by the Data Processing Agreement (see Section 4.4 of that agreement), and individual users should read that Provider’s terms before using it.
6. Model Disclosure Table
SuperX publishes the Disclosure Table for each Model on this page or on the Model’s page in the Services, using information provided by each Provider and SuperX’s agreements with Providers; a Disclosure Table published on a Model’s page forms part of this page and of these Model Terms. The table below describes the information that the Disclosure Table shows. Where a Model is offered in both hosting modes, the Disclosure Table shows both. Your Custom Data Policies decide which is used; if they do not, the SuperX-hosted mode is used (Section 2.3).
| Model | Provider | Hosting mode | Processing location | Provider Terms / license | Retention / training |
|---|---|---|---|---|---|
| The Model’s name and version | The Provider and its contracting entity | SuperX-hosted, Provider API or both | A country, or “Global” | Terms: links to the applicable Provider Terms License: the license under which the Model is made available Output limits: any known restrictions on the use of Outputs (Section 4.7) Third-party beneficiary: whether the Provider is a third-party beneficiary (Section 4.2) | Retention: how long the Provider retains data received through SuperX Uses your data for training: whether the Provider may use that data to train or improve its models Zero retention option: whether a zero-retention option is available |
Models, versions and Providers change. SuperX will publish the Disclosure Table for a Model before making the Model generally available through SuperX AI. If no Disclosure Table has been published for a Model that is available to you, do not use that Model to process personal data or confidential information until one has been published. You can also contact us for details.
7. Users in the EEA and the UK
7.1 You may be in the European Economic Area or the United Kingdom, or you may submit personal data of individuals there. In either case, a Provider API request may transfer personal data to a country that has not been recognized as providing an adequate level of data protection. For these transfers SuperX relies on the standard contractual clauses approved by the European Commission. For the United Kingdom it relies on the International Data Transfer Agreement or the UK Addendum. Transfer risk assessments and supplementary measures are added where required. SuperX does not treat your use of the service as consent to these transfers.
7.2 SuperX may restrict or disable particular Models, hosting modes or processing locations for users or organizations in the EEA or the UK, or require a Custom Data Policy. It may do so where it cannot ensure an appropriate transfer mechanism or where the law otherwise requires.
7.3 Business customers should also review the Data Processing Agreement and the Sub-processor List.
8. Sensitive data and no reliance
8.1 Think before you submit. Do not submit any of the following to a Model unless you are legally permitted to and have assessed the risks. This applies to every Model, and particularly to a Provider API Model processed outside your own country:
-
special categories of personal data (such as health, biometric or genetic data, or data revealing racial or ethnic origin, religious beliefs, political opinions or sex life);
-
government identification numbers, financial account or payment card data;
-
passwords, API keys or other credentials;
-
children’s data;
-
export-controlled technical data; or
-
other people’s confidential information.
For sensitive workloads, a SuperX-hosted Model may be more suitable, with a Custom Data Policy that limits routing to SuperX-hosted Models.
8.2 Foreign law. Data processed in another country is subject to that country’s laws. Those laws may give authorities rights of access to the data and may protect it less than the laws of your own country.
8.3 No reliance on Outputs. Models are developed by different Providers and behave differently. Outputs may be inaccurate, incomplete, biased or out of date. They may also reflect the Provider’s own content rules or legal requirements. Do not rely on Outputs for decisions with legal, medical, financial, safety or other significant effects without independent verification and appropriate human review.
8.4 Disclosures are informational. The information in these Model Terms, including the Disclosure Table, reflects our understanding of each Model and Provider when it is published or last updated. It is based on information and contractual commitments from Providers, and SuperX does not control Providers’ systems. It is provided to help you make informed choices and is not a warranty. SuperX’s responsibilities are those set out in the Master Agreement and, where applicable, the Data Processing Agreement.
9. Changes
SuperX may update the Disclosure Table at any time to reflect changes to Models or Providers, as described in Section 4.3. Changes to the rest of these Model Terms follow the change provisions of the Master Agreement. Material adverse changes take effect after at least 15 days’ notice. Changes that are required by law, made for security reasons, imposed by a Provider, or that relate to new Models or features may apply immediately.

5. User Content
Terms of Use
6. User Content and Data Use
The Services may allow you to submit, upload, create, store, process, transmit, or share content, including prompts, text, images, video, audio, documents, code, canvas projects, workflows, and AI-generated content (“User Content”).
6.1 Ownership
Subject to the rights of third parties and applicable law, you retain your ownership rights in User Content that you submit to or create through the Services.
Nothing in these Terms transfers ownership of your User Content to SuperX.
6.2 License to SuperX
You grant SuperX a non-exclusive, worldwide, limited, royalty-free license to host, store, reproduce, process, transmit, display, modify, and otherwise use your User Content, including through members of the SuperX Group, our service providers, and the Model Providers you use, only as reasonably necessary to:
-
Provide and operate the Services;
-
Process your requests;
-
Run AI models and workflows;
-
Store and synchronize your projects;
-
Enable collaboration and sharing features;
-
Maintain and secure the Services;
-
Prevent fraud and abuse;
-
Troubleshoot and provide customer support;
-
Comply with applicable law;
-
Perform other activities you request or that are reasonably necessary to provide the Services to you.
This license ends when your User Content is deleted from the Services, except as described in Section 7 for Published Content and to the extent retention is reasonably necessary for legal, security, backup, or dispute resolution purposes, in which case the license continues only for as long as that retention lasts.
6.3 Your Responsibility
You represent and warrant that:
-
You own or have sufficient rights to your User Content;
-
You have obtained all necessary permissions and consents;
-
Your User Content does not unlawfully infringe third-party rights;
-
You have the legal authority to submit the content to the Services;
-
Your use of the content complies with applicable laws.
You are solely responsible for your User Content and the consequences of submitting, generating, publishing, or sharing it.
6.4 No Training Without Your Opt-In
SuperX does not use your User Content, including your prompts, uploads, and Generated Content, to train or improve AI models unless you opt in. If we offer an opt-in, we will explain what it covers, and you may withdraw it at any time in your settings with effect for the future. We may use aggregated and de-identified information about use of the Services, such as token counts, latency, and error rates, that does not identify you or any individual, to operate, secure, and improve the Services.
6.5 Model Provider Data Practices
When a request is sent to a Model Provider, the provider may retain it for a period and, in some cases, use it under its own terms. The Model Terms disclose, for each model, the provider's retention and training practices as disclosed to us, and indicate which models support zero data retention. Where a Model Provider offers a no-training or zero-data-retention option, we will use commercially reasonable efforts to enable it where it is available to us. You can use the data policy settings in your account to send requests only to providers that meet your requirements.
6.6 Prompt and Response Logging
If we offer prompt logging, it is off by default. Unless you turn it on, we do not keep the content of your API and model marketplace prompts and responses after the response has been delivered, except for usage and billing records, content we need to investigate suspected abuse or illegal content, and content we must keep by law. If you turn on prompt logging, for example to view your request history, we store your prompts and responses for the period shown in your settings, and you can turn logging off at any time. Organization administrators may control logging for their members. Content that you create or save in our content creation tools, AI applications, or your projects is stored so that you can use it, until you delete it.
We may use automated tools to scan prompts and outputs in transit to detect and prevent illegal content and abuse, as described in Section 18.
7. Published Content, Gallery and Creator Program
Some Services let you publish works, canvas projects, reusable prompts, workflows, and similar items to the Gallery, or share them by public link (“Published Content”). Published Content can be seen by anyone, including people who do not have an account. Only publish content you are entitled to make public, and make sure it complies with these Terms and the Content and Community Policy.
7.1 License to SuperX
When you publish content, you grant SuperX a worldwide, non-exclusive, royalty-free license, which we may sublicense to members of the SuperX Group and our service providers, to host, store, reproduce, display, perform, distribute, and adapt your Published Content (for example, to resize, crop, or translate it, or to create thumbnails, previews, and excerpts), and to use your display name and avatar with it, in order to operate, display, recommend, feature, and promote the Services, including on our websites, apps, and social media channels.
7.2 License to Other Users
Other users may view your Published Content and, where the Services offer the feature, clone the prompts, parameters, and workflows associated with it and use them to create their own works within SuperX AI. You grant each user of the Services a worldwide, non-exclusive, royalty-free license to do so within the Services. This license does not allow other users to copy or use your Published Content outside the Services, except through features you enable (such as downloads) or as permitted by law.
7.3 Unpublishing
You can unpublish your Published Content at any time, and we will remove it from the Gallery within a reasonable time. Unpublishing ends the licenses in Sections 7.1 and 7.2 for the future, but does not affect: (a) clones and works that other users created before you unpublished, which they may continue to use within the Services; (b) promotional materials we created or distributed before you unpublished; (c) copies we retain as described in Section 6.2; or (d) any license granted under the Creator License Agreement.
7.4 How the Gallery Recommends Content
The Gallery uses automated systems to decide which works to show and in what order. Section 4.4 of the Content and Community Policy describes the main parameters of those systems, their relative importance, and the options you have to influence what you see. Content that may breach the Content and Community Policy may be shown less prominently or not at all.
7.5 Creator Program
If you join the Creator Program to offer works, canvas projects, reusable prompts, workflows, or similar items to others, including for rewards or revenue, the Creator License Agreement (https://aicloud.superx.sg/terms) also applies and prevails over this Section 7 for content you submit to the Creator Program.
We may decline to publish, remove, label, or restrict the visibility of any Published Content, or stop featuring it, as described in Section 20.
8. AI-Generated Content
Depending on the Service, AI-generated content may include text, images, videos, audio, code, designs, and other materials (“Generated Content”).
As between you and SuperX, and to the extent permitted by applicable law, you own the Generated Content you create through the Services, and SuperX assigns to you any rights it may have in it. This is subject to the applicable Provider Terms, the rights of third parties, applicable law, and these Terms. Subject to the same limits, you may use Generated Content for lawful purposes.
However:
-
SuperX does not guarantee that Generated Content is legally protectable by copyright or other intellectual property rights;
-
Generated Content may be similar or identical to content generated for other users, and your rights do not extend to their content;
-
You are responsible for determining whether your intended use of Generated Content complies with applicable laws and third-party rights;
-
You are responsible for obtaining any necessary licenses for third-party materials incorporated into your inputs or outputs.
Where a Model Provider imposes restrictions on Generated Content (see Section 5.7), those restrictions apply to your use of the relevant output.
Labeling and provenance. To comply with law, including Article 50 of the EU Artificial Intelligence Act, and to promote transparency, SuperX may apply visible labels or watermarks to Generated Content, and may mark images, video, audio, and text generated through the Services using invisible watermarks, provenance metadata, or other labeling technologies. You must not remove, alter, obscure, or disable any such label, watermark, metadata, or other marking, or use tools designed to do so, except where the law expressly permits it.
Disclosing AI-generated content. If you publish or distribute Generated Content that is a “deepfake” (image, audio, or video content that resembles real people, objects, places, entities, or events and would falsely appear to a person to be authentic or truthful), or AI-generated text published to inform the public on matters of public interest, you must clearly disclose that the content has been artificially generated or manipulated where the law requires, including under Article 50(4) of the EU Artificial Intelligence Act, in the manner and subject to the exceptions the law provides. You must not present Generated Content as human-made in order to mislead others.
9. Content Creation Tools and AI Applications
Our content creation tools and AI applications may allow you to create projects, workflows, designs, AI-generated content, and collaborative workspaces.
You are responsible for:
-
The content stored in your canvases and projects;
-
The legality of your projects;
-
Access permissions;
-
Shared content;
-
Collaborator permissions;
-
The use of third-party assets;
-
The use of AI-generated materials.
If you share a canvas or project with other users, those users may be able to view, edit, copy, or export the content according to the permissions you select, and they may keep copies they made before you change the permissions or stop sharing.
SuperX is not responsible for unauthorized disclosure caused by your failure to configure appropriate sharing or access settings.
Agent workflows. When you run agent workflows, the agent may take multiple steps automatically, call models and tools, and consume credits at each step. You are responsible for configuring and supervising your workflows, for any actions you instruct an agent to take, and for reviewing results before relying on them.
SuperX-AI Creator License Agreement
SuperX-AI Creator License Agreement
Last Updated: September 28, 2026
This SuperX-AI Creator License Agreement (this “Agreement”) is a contract between SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore with its registered office at 30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440 (“SuperX”, “we”, “us” or “our”), and the person who accepts it (the “Creator”, “you” or “your”). It sets out the terms on which you license works that you choose to make available through the SuperX AI creator program (the “Creator Program”) on SuperX AI, which includes aicloud.superx.sg and the SuperX-AI app at aicloud.superx.sg/ai-apps (together, “SuperX AI”).
Important notice
-
You accept this Agreement by checking the box, or clicking “Agree”, “Join” or a similarly labeled button, when you opt into the Creator Program. By doing so you confirm that you have read and agree to this Agreement and that it is a legally binding electronic contract between you and SuperX. You must be at least 18 years old. If you accept on behalf of an organization, you confirm that you are authorized to bind it, and “you” then includes that organization. SuperX records the version of this Agreement you accepted, the date and time of acceptance, your account ID and your IP address.
-
This Agreement supplements the SuperX AI Terms of Use (https://aicloud.superx.sg/terms) (the “Terms of Use”) and applies in addition to them while you take part in the Creator Program. The Content and Community Policy (https://aicloud.superx.sg/terms), the Copyright and Intellectual Property Policy (https://aicloud.superx.sg/terms) (the “Copyright Policy”), the Model Terms and Provider Disclosures (https://aicloud.superx.sg/terms) and the Export Compliance Terms (https://aicloud.superx.sg/terms) also apply. Our Privacy Policy (https://aicloud.superx.sg/privacy) explains how we handle personal data in connection with the Creator Program. If these documents conflict: (a) the Content and Community Policy and the Export Compliance Terms prevail; (b) otherwise, this Agreement prevails over the Terms of Use on matters concerning Licensed Works and the Creator Program; and (c) the Terms of Use prevail on all other matters. A separate agreement signed by you and SuperX prevails where it expressly says so.
-
SuperX may update this Agreement from time to time. If an update is material and adverse to you, we will give you at least 15 days’ notice by email or in the product before it takes effect. Updates required by law or for security reasons, and updates that relate only to new features, may take effect immediately. If you do not agree to an update, you may withdraw your Licensed Works under Section 10 before it takes effect. If you continue to take part in the Creator Program after the effective date, the updated Agreement applies to you. Updates do not apply to disputes that arose before they took effect.
-
Taking part in the Creator Program is voluntary. You choose, work by work, what to include, and you may use SuperX AI without joining. In summary: you keep ownership of your works; the license you give SuperX is non-exclusive; the Creator Program is royalty-free unless separate Monetization Terms apply; you decide what other users may do with each work; and you may withdraw works at any time. This summary is for convenience only and does not replace the terms below.
1. Definitions and participation
1.1 Definitions. In this Agreement:
-
“Licensed Work” means each work, prompt, workflow, canvas project or similar item that you publish on SuperX AI and designate for the Creator Program under Section 1.2, including its text, instructions, parameters, node and tool configurations, reference and sample assets, sample Outputs, cover images, titles and descriptions, for as long as the designation remains in effect. Similar items include any reusable set of instructions, prompts, tools or configurations that can be run within SuperX AI.
-
“License Option” means the option for use by Platform Users that you select for a Licensed Work under Section 6.
-
“Monetization Terms” has the meaning given in Section 8.2.
-
“Outputs” means text, images, video, audio and other content generated by an AI model through SuperX AI.
-
“Platform User” means any visitor to or user of SuperX AI other than you.
-
“Restricted Party” and “Restricted Jurisdiction” have the meanings given in the Export Compliance Terms.
-
“SuperX Group” means SuperX AI Technology Limited and its subsidiaries.
Capitalized terms that are not defined in this Agreement have the meanings given in the Terms of Use.
1.2 Designation of works. A work becomes a Licensed Work only when you designate it for the Creator Program, for example by enabling the Creator Program setting and selecting a License Option when you publish the work or afterwards. Joining the Creator Program does not designate any work automatically. A work that you publish on SuperX AI without designating it (for example, in the public gallery (the “Gallery”)) is not a Licensed Work and is governed by the Terms of Use alone.
1.3 Ownership. You keep all ownership rights that you have in your Licensed Works. This Agreement grants licenses only; it does not transfer ownership of any Licensed Work to SuperX or to Platform Users. SuperX and its licensors keep all rights in SuperX AI, including its software, interfaces and templates and any assets or tools that SuperX provides and that you include in a Licensed Work.
1.4 Eligibility. To join the Creator Program you must: (a) be at least 18 years old; (b) hold a SuperX AI account in good standing; (c) not be a Restricted Party, or located, organized or ordinarily resident in a Restricted Jurisdiction; and (d) if you join on behalf of an organization, be authorized to bind it. SuperX may decline or end your participation if you do not meet these requirements.
2. Creator representations and warranties
Each time you designate a Licensed Work, and for as long as it remains in the Creator Program, you represent and warrant to SuperX that:
-
the Licensed Work is your own original creation, or you otherwise own or control all rights in it that are needed to grant the licenses in this Agreement for the License Option you selected;
-
neither the Licensed Work nor its use as permitted by this Agreement infringes, misappropriates or violates any copyright, trademark, design right, patent, trade secret, database right, right of privacy or publicity, or other right of any person;
-
the Licensed Work is not another person’s work, prompt, workflow, project or similar item presented as your own after only superficial changes (for example, renaming it, adjusting its parameters or swapping its sample assets);
-
you have not translated, split, recombined, obscured or otherwise altered third-party material to disguise its source or to avoid SuperX’s rights, safety or content review;
-
if the Licensed Work was created with others, every co-creator has consented to its designation and to the License Option you selected, and you are authorized to accept this Agreement on their behalf;
-
if the Licensed Work was created in the course of employment, under a commission or other contract, or is otherwise subject to the rights of a third party (such as an employer or client), those rights have been cleared or waived so that you may designate and license it under this Agreement;
-
you hold all licenses, releases and consents required for all material included in or used to create the Licensed Work, including third-party content, any name, likeness or voice of a real person and any trademark, as described in Section 5;
-
the Licensed Work does not contain confidential information or trade secrets of any person, or personal data of anyone other than you unless you have a lawful basis to share it in this way;
-
you have disclosed, using the labels or settings provided in the product, that the Licensed Work contains AI-generated components, and you have not removed or altered any label, watermark or provenance metadata applied to Outputs;
-
the Licensed Work complies with the Terms of Use, the Content and Community Policy, the model provider terms described in the Model Terms and Provider Disclosures, and applicable law;
-
no prompt, workflow, canvas project or similar item contains malicious code, hidden instructions or undisclosed functions designed to collect data, access external systems or act without the knowledge of the person running it; and
-
the title, description, tags and other information you provide about the Licensed Work are accurate and not misleading.
You must tell SuperX promptly if any of these statements stops being true for a Licensed Work, and withdraw the work under Section 10 if the issue cannot be fixed.
3. License to SuperX
3.1 Grant. For each Licensed Work, you grant SuperX a non-exclusive, worldwide, royalty-free (unless Monetization Terms provide otherwise) license, for the period described in Section 10, to: (a) host, store, cache, reproduce, transmit, publicly display, publicly perform and make available the Licensed Work on and through SuperX AI; (b) format, resize, transcode, compress, crop, excerpt, create previews and thumbnails of, and otherwise adapt the Licensed Work for technical and display purposes, without changing its substance; (c) index, categorize, rank, recommend and feature the Licensed Work in the Gallery, in search results and elsewhere in SuperX AI; (d) use the Licensed Work for promotion as described in Section 3.2; and (e) grant sublicenses to Platform Users as described in Section 3.3.
3.2 Promotion. SuperX may use Licensed Works (including excerpts, stills, clips and sample Outputs), together with your display name, handle and profile image, to promote the Creator Program, the Gallery and SuperX AI, both within SuperX AI and in marketing materials in any media, such as websites, social media, newsletters, advertisements, presentations and events. SuperX will attribute the Licensed Work to you where reasonably feasible (Section 9.1), will not edit it in a way that misrepresents it, and will not state or imply that you endorse any SuperX product or service, beyond your participation in the Creator Program, without your consent.
3.3 Sublicenses to Platform Users. SuperX may grant Platform Users a non-exclusive, non-transferable sublicense to use a Licensed Work only within the scope of the License Option you selected for it (Section 6) and subject to the Terms of Use. SuperX will not grant Platform Users broader rights than your License Option allows, and will not license Licensed Works to any other third party under this Agreement.
3.4 SuperX Group and service providers. SuperX may exercise its rights under this Agreement through members of the SuperX Group and service providers that host or operate SuperX AI on its behalf, solely for SuperX’s purposes under this Agreement. SuperX remains responsible for them.
3.5 No AI training. This Agreement does not permit SuperX to use Licensed Works to train or fine-tune AI models. SuperX will do so only if you give separate, opt-in consent. SuperX may use aggregated, de-identified statistics about the Creator Program, such as view and clone counts.
3.6 Models selected by Platform Users. When a Platform User runs a cloned prompt, workflow, canvas project or similar item, its content is processed by the AI models that the Platform User selects, as described in the Model Terms and Provider Disclosures.
3.7 No obligation to use. SuperX is not obliged to use, display, feature or promote any Licensed Work, or to keep it available.
4. Restrictions on use
4.1 SuperX will not use, and will not authorize Platform Users to use, a Licensed Work: (a) for any unlawful purpose; (b) in a way that is defamatory of you or of any other person; (c) for pornographic or sexually explicit purposes; or (d) in a way that states or implies that you endorse any product, service, cause or political position, without your consent. The Terms of Use and the Content and Community Policy prohibit Platform Users from these uses.
4.2 Takedown steps. If SuperX becomes aware, including through a report from you, that a Licensed Work, or a clone or remix of it, is being used on SuperX AI in breach of Section 4.1 or of the applicable License Option, SuperX will take reasonable steps to stop that use. These may include removing or disabling access to the content concerned, disabling cloning, and restricting, suspending or terminating the account concerned in accordance with the Content and Community Policy. SuperX cannot control uses outside SuperX AI (for example, of Outputs that a Platform User has downloaded), but will reasonably cooperate with your lawful efforts to stop them, subject to its legal and privacy obligations.
5. Third-party materials and pre-existing rights
5.1 You are solely responsible for all material included in or used to create a Licensed Work, including text, images, video, audio, fonts, code, reference materials, characters, brand elements and any name, likeness or voice of a real person (“Third-Party Materials”). Before designating a Licensed Work, you must obtain every license, permission, release and consent needed for SuperX and Platform Users to use the Licensed Work, including its Third-Party Materials, as permitted by this Agreement and by the License Option you select, including commercial use of Outputs where you select that option.
5.2 Likenesses and voices. If a Licensed Work depicts or imitates an identifiable real person, including through a consistent character, avatar, face, body or voice model, you must have that person’s express written consent covering the License Option you select, keep a record of that consent, and provide it to SuperX on request. You must not designate a Licensed Work that depicts an identifiable real minor. Works that sexualize, demean or deceptively depict a real person are not permitted under any License Option (see the Content and Community Policy).
5.3 Trademarks, open licenses and model terms. Do not include another person’s trademarks, logos or trade dress unless you are authorized to use them in the way permitted by your License Option. If a Licensed Work includes material made available under an open-source or other public license, or Outputs of a model whose terms restrict how they may be used, you must comply with those terms and must not select a License Option they do not permit (for example, commercial use of material licensed for non-commercial use only).
6. License Options
6.1 When you designate a work, you select one of the License Options shown in the product. Unless the product describes an option differently when you select it, the License Options are:
(a) View Only: Platform Users may view the Licensed Work on SuperX AI and share links to it, but may not copy, clone, download or remix it;
(b) Clone and Remix within SuperX AI: in addition to View Only, Platform Users with a SuperX AI account may copy the Licensed Work into their own workspace, run and modify it and publish remixes on SuperX AI, and may use the Outputs they generate with it for personal, non-commercial purposes, including outside SuperX AI; and
(c) Commercial Use of Outputs: in addition to Clone and Remix within SuperX AI, Platform Users may use the Outputs they generate with the Licensed Work, including Outputs that incorporate characters, styles or other elements of it, for any lawful purpose, including commercial purposes, subject to the Terms of Use and to any model provider terms described in the Model Terms and Provider Disclosures.
6.2 Limits of every option. No License Option permits a Platform User to sell, license or distribute a Licensed Work itself (as opposed to Outputs) as a standalone product outside SuperX AI, for example as a prompt pack or template, to claim authorship of it, or to use it in breach of the Terms of Use or the Content and Community Policy. A remix remains subject to the License Option of the Licensed Work from which it derives.
6.3 Default option. If you designate a work without selecting a License Option, View Only applies.
6.4 Changing an option. You may change the License Option for a Licensed Work at any time. A change to a broader option takes effect when you save it. A change to a narrower option takes effect in the same way as a withdrawal under Section 10 and does not affect clones, remixes or Outputs made before it takes effect.
6.5 Continuing sublicenses. A sublicense that covers a clone, remix or Output made while a License Option applied continues after that option is narrowed, after the Licensed Work is withdrawn and after this Agreement ends (Section 10.3). SuperX may nevertheless end a sublicense if the Platform User breaches the Terms of Use or the License Option, or if SuperX reasonably believes that the Licensed Work or its use is unlawful or infringes the rights of others.
7. Exclusive arrangements
7.1 The licenses you grant under this Agreement are non-exclusive. You remain free to use, publish and license your Licensed Works elsewhere and to anyone, provided that doing so does not conflict with rights already granted under this Agreement. SuperX is not your agent and does not negotiate or grant licenses to third parties on your behalf.
7.2 An exclusive arrangement (for example, exclusive distribution or licensing of a work, or SuperX acting as your exclusive licensing representative) may be made only by a separate written agreement signed by you and by an authorized signatory of SuperX. Accepting this Agreement, designating a work or taking part in a campaign never creates exclusivity. A separate exclusive agreement prevails over this Agreement on its subject matter.
7.3 If you later grant exclusive rights in a Licensed Work to someone else, you must first withdraw it under Section 10 or ensure that the exclusive grant preserves the rights already granted under this Agreement.
8. Monetization
8.1 Unless Monetization Terms apply to you, the Creator Program is not a paid program: SuperX pays no fees, royalties, revenue share or other compensation for Licensed Works, and the licenses under this Agreement are royalty-free.
8.2 SuperX may publish separate creator monetization terms (“Monetization Terms”). They will apply only if you accept them separately and will set out eligibility, how any payments are calculated, payment timing and methods, currency, taxes (including withholding and tax documentation), identity verification (KYC), and anti-money laundering, sanctions and export-control screening. On those matters, the Monetization Terms prevail over this Agreement.
8.3 Any payment or reward is conditional on your compliance with this Agreement, the Terms of Use and any Monetization Terms, and on successful completion of the checks they describe. SuperX will not make payments to Restricted Parties or to persons located, organized or ordinarily resident in Restricted Jurisdictions, and may withhold or recover payments connected with fraud, artificial engagement or a breach of this Agreement.
8.4 Promotional rewards, such as credits or badges offered in campaigns, are governed by the campaign rules and the Payments, Credits and Refund Policy (https://aicloud.superx.sg/terms) and have no cash value unless those rules state otherwise. You are responsible for your own taxes on anything you receive.
9. Attribution and moral rights
9.1 Attribution. Where reasonably feasible, SuperX will identify you as the creator of a Licensed Work by the display name or handle on your SuperX AI profile (or another credit you specify in the product), including on the Licensed Work’s Gallery page, on clones and remixes where the product supports it, and in marketing materials. Attribution may be shortened or omitted where it is not reasonably feasible, for example in thumbnails, search results, small-format or short-form promotional content, technical copies and API responses. Platform Users must not remove your attribution where the product displays it.
9.2 Moral rights. The Copyright Act 2021 of Singapore gives authors a right to be identified as the author of a work in certain circumstances and a right not to have authorship falsely attributed, and other countries may grant further moral rights, such as a right of integrity. To the extent permitted by applicable law, you consent to SuperX, members of the SuperX Group and Platform Users acting within their licenses doing any act permitted by this Agreement that would otherwise infringe those rights, including identifying you by handle or pseudonym, omitting attribution as described in Section 9.1, and making the modifications and remixes permitted by your License Option. Where the law permits a waiver, you waive, and agree not to assert, those rights in respect of those acts.
9.3 Where the law does not allow moral rights to be waived or consented to in advance, Section 9.2 applies only to the extent permitted. SuperX will not falsely attribute authorship of a Licensed Work to anyone other than you.
10. Withdrawal and unpublishing
10.1 Your right to withdraw. You may withdraw any or all Licensed Works from the Creator Program at any time, using the controls in the product, where available, or by emailing support.ai@superx.sg from the email address linked to your account and identifying the works concerned.
10.2 When withdrawal takes effect. A withdrawal takes effect as soon as practicable and in any event within 30 days after SuperX receives it (the “Withdrawal Period”). Once it takes effect: (a) the work is no longer displayed or promoted as part of the Creator Program; (b) Platform Users can no longer make new clones, remixes or other uses of it under its License Option; and (c) SuperX will not include it in new marketing materials.
10.3 What continues after withdrawal. (a) Clones, remixes and Outputs that Platform Users made before the withdrawal took effect, and the sublicenses covering them, continue under the License Option that applied when they were made (subject to Section 6.5). (b) SuperX need not recall or delete marketing materials published or distributed before the withdrawal took effect, but will not use the work in new materials. (c) SuperX may keep copies to the extent needed to comply with law, resolve disputes, enforce its terms or protect safety, and backup copies until they are overwritten in the ordinary course. Otherwise, the license in Section 3 ends for the withdrawn work.
10.4 Unpublishing and account closure. Unpublishing, making private or deleting a Licensed Work removes it from public display on SuperX AI as described in the product, and counts as a withdrawal of that work under this Section 10. Closing your account counts as a withdrawal of all your Licensed Works. Unpublishing a work does not remove clones or remixes that Platform Users made before the withdrawal took effect.
11. Removal and refusal of works
11.1 SuperX may decline to accept a work into the Creator Program, remove a Licensed Work from the Creator Program or the Gallery, restrict its visibility, or disable cloning or a particular License Option, at any time, including where: (a) SuperX reasonably believes the work may breach this Agreement, the Terms of Use, the Content and Community Policy or applicable law; (b) SuperX receives a complaint, notice or order about it; (c) a model provider’s terms require it; (d) it is necessary to protect Platform Users, third parties or SuperX; or (e) for editorial, quality or product reasons.
11.2 Where required by law, including the EU Digital Services Act, SuperX will give you a statement of reasons for a decision under Section 11.1 that is based on the alleged illegality of the work or its incompatibility with SuperX’s terms, and you may challenge the decision through the complaint process in the Content and Community Policy.
11.3 SuperX has no obligation to monitor Licensed Works, or to host or keep any Licensed Work available. Keep your own copies of your works.
12. Complaints and takedown cooperation
12.1 Notices about your works. SuperX handles notices about intellectual property under the Copyright Policy, and notices about other illegal or harmful content (including non-consensual intimate images, which SuperX removes within 48 hours of a valid request) under the Content and Community Policy. SuperX may remove or disable access to a Licensed Work, and to clones or remixes of it where appropriate, and will notify you unless the law prohibits it or notice would create a risk of harm.
12.2 Your cooperation. If SuperX asks, you will promptly, and in any event within 7 days or any shorter period required by law or by the circumstances, provide reasonable information and evidence of your rights, licenses and consents, and take reasonable steps to resolve the complaint. If you believe a work was removed by mistake, you may send a counter-notice under the Copyright Policy or complain under the Content and Community Policy.
12.3 Claims you learn of. If you receive or become aware of a claim that a Licensed Work infringes the rights of others or is unlawful, you must tell SuperX promptly at copyright@superx.sg (for intellectual property claims) or abuse@superx.sg (for other claims).
12.4 Infringement by others. You may report infringement of your Licensed Works by others under the Copyright Policy. SuperX will act on valid notices, but is not obliged to take legal action against any third party or to act as your agent in enforcing your rights.
13. Liability and suspension
13.1 Suspension and termination. SuperX may suspend your participation in the Creator Program, remove your Licensed Works from it or end this Agreement, with immediate effect where reasonably necessary, if: (a) you breach this Agreement, the Terms of Use or the Content and Community Policy and, where the breach can be remedied, you do not remedy it within a reasonable time after notice; (b) required by law, a court, a competent authority or a model provider; (c) there is a risk of fraud, harm to others or legal exposure for SuperX; or (d) your SuperX AI account is suspended or terminated. SuperX may also discontinue the Creator Program for all Creators on at least 15 days’ notice. You may end this Agreement at any time by withdrawing all your Licensed Works or closing your account. When this Agreement ends, Section 10.3 applies to all your Licensed Works as if you had withdrawn them. Where required by law, SuperX will give you a statement of reasons and access to a complaint procedure.
13.2 AI-generated works. The law on the ownership and protection of works created with AI is unsettled, differs between countries and may change. Copyright or other protection may not be available for material generated by AI without sufficient human creative contribution. SuperX does not guarantee that any Licensed Work, or any part of it created with AI, is protectable, registrable or enforceable, or that you own rights in it. AI Outputs are not unique: other users may independently create similar content, which does not by itself infringe your Licensed Work, and SuperX has no obligation to act against it. You accept these risks by joining the Creator Program.
13.3 Platform Users. Platform Users are responsible for their own use of Licensed Works and Outputs. SuperX does not control, and is not responsible for, uses outside SuperX AI or uses in breach of a License Option, but will act as described in Section 4.2. You are not responsible for a Platform User’s independent misuse of a Licensed Work, except to the extent that it results from your breach of this Agreement.
13.4 Indemnity. You will indemnify SuperX, the members of the SuperX Group and their respective directors, officers and employees against all losses, damages, liabilities, costs and reasonable legal fees arising from any third-party claim or regulatory action that alleges that a Licensed Work, or its use as permitted by this Agreement, infringes or violates the rights of any person or applicable law, or that arises from your breach of Section 2 or Section 5. SuperX will notify you promptly of any such claim, allow you to participate in (and, where SuperX agrees, control) its defense, and not settle it in a way that imposes liability on you without your consent, which you will not unreasonably withhold. If you are a consumer, this Section 13.4 applies only to the extent permitted by applicable consumer law and only to losses caused by your breach.
13.5 Limitation of liability. To the extent permitted by law: (a) SuperX is not liable to you under or in connection with this Agreement for any indirect, consequential, special or punitive damages, or for any loss of profits, revenue, goodwill or data; and (b) SuperX’s total aggregate liability under or in connection with this Agreement is limited to the greater of (i) the total amounts paid by SuperX to you under any Monetization Terms in the 12 months before the event giving rise to the claim and (ii) USD 100. This Section 13.5 does not limit SuperX’s liability for fraud, fraudulent misrepresentation or willful misconduct, for death or personal injury caused by negligence, or any liability that cannot be limited or excluded by law, and it does not limit your liability to SuperX.
13.6 Mandatory rights. If you are a consumer, nothing in this Agreement affects your statutory rights that cannot be excluded or limited by contract.
14. Governing law and disputes
14.1 This Agreement, and any dispute or claim arising out of or in connection with it, is governed by the governing law and dispute resolution provisions of the Terms of Use, which apply to this Agreement as if set out in full.
14.2 In summary, those provisions provide for Singapore law and good-faith negotiation, followed by confidential arbitration in Singapore administered by the Singapore International Arbitration Centre, on an individual basis. Consumers to whom the arbitration provisions apply may instead bring an individual claim in a small-claims court. If you are a consumer in the European Union, the European Economic Area or the United Kingdom, or in any other jurisdiction whose law does not permit pre-dispute arbitration agreements with consumers, the arbitration provisions do not apply to you, and you may bring proceedings in the courts where you live and keep the protection of the mandatory laws of that jurisdiction. If this summary differs from the Terms of Use, the Terms of Use prevail.
15. General
15.1 Entire agreement. This Agreement, together with the documents referred to in item 2 of the Important notice above, is the entire agreement between you and SuperX about the Creator Program. A separate signed agreement and any Monetization Terms prevail on their subject matter as described in Sections 7.2 and 8.2.
15.2 Assignment. SuperX may assign or transfer this Agreement, including the licenses granted to it, to a member of the SuperX Group or to a successor to all or part of its business, on notice to you. You may not assign or transfer this Agreement without SuperX’s prior written consent.
15.3 Relationship. You and SuperX are independent parties. This Agreement does not create an employment, partnership, joint venture, agency or fiduciary relationship.
15.4 Third-party rights. Except for members of the SuperX Group and the persons indemnified under Section 13.4, who may enforce the provisions that benefit them, no person other than you and SuperX has any right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce this Agreement. You and SuperX may amend or end this Agreement without the consent of any third party.
15.5 Severability and waiver. If any provision of this Agreement is held invalid or unenforceable, the rest of this Agreement remains in effect. A failure or delay in exercising a right is not a waiver of it.
15.6 Language and electronic form. This Agreement is made in English. If it is translated, the English version prevails to the extent permitted by law. This Agreement is concluded electronically in accordance with the Electronic Transactions Act 2010 of Singapore.
15.7 Notices. SuperX may send you notices by email to the address linked to your account or through the product. Legal notices to SuperX must be sent to legal@superx.sg and to its registered office address.
15.8 Survival. Sections 2 (for Licensed Works designated before this Agreement ends), 6.5, 9.2, 9.3, 10.3, 12, 13.2 to 13.6, 14 and 15, and any rights and obligations that accrued before this Agreement ends, survive its end.

We may use automated tools, such as hash-matching and classifiers, together with human review, to detect and prevent illegal content, including child sexual abuse material and non-consensual intimate imagery. We report child sexual abuse material to the competent authorities or designated organizations where the law requires. We handle requests from government and law enforcement authorities as described in our Law Enforcement Policy (https://aicloud.superx.sg/privacy). If you discover a security vulnerability or incident affecting the Services, please report it to security@superx.sg.
20. Content Moderation, Notices and Complaints
This Section explains how we moderate content and how you can report content and challenge our decisions, including under the EU Digital Services Act (the “DSA”).
20.1 How We Moderate Content
We may review content and activity on the Services to enforce these Terms and the Content and Community Policy and to comply with law. We use a combination of automated tools, such as input and output filters, classifiers, hash-matching, and keyword detection, and review by trained staff. Automated tools may block a prompt or output in real time. The measures we may take include refusing to generate content, removing or disabling access to content, reducing the visibility of content in the Gallery, labeling content, removing content from the Creator Program or withholding rewards, restricting features, and suspending or terminating accounts.
20.2 Reporting Illegal Content
Anyone can tell us about content on the Services that they believe is illegal or breaches the Content and Community Policy, using the reporting function or online reporting form in the Services, where available, or by email to abuse@superx.sg. A report should include: (a) an explanation of why the content is illegal or in breach; (b) its exact location, such as the URL; (c) your name and email address, except for reports of child sexual abuse material; and (d) a statement that you believe in good faith that the information in the report is accurate and complete. We will confirm receipt, handle reports in a timely, diligent, non-arbitrary, and objective manner, and tell you our decision and the ways to challenge it.
20.3 Statement of Reasons
If we remove or restrict your content, reduce its visibility, suspend or terminate your account, or suspend or withhold payments or rewards because we consider your content illegal or in breach of these Terms, we will give you a clear and specific statement of reasons, unless the law prevents us from doing so. The statement will explain what we decided, the facts and circumstances relied on, whether automated means were used, the legal or contractual ground, and the ways you can challenge the decision.
20.4 Complaints and Appeals
You can complain about a decision we have made about your content or account, or about a report you submitted, free of charge and within six months of being informed of the decision, by using the appeal link in our notice or in the product, or by email to abuse@superx.sg quoting your reference number. Complaints are handled by qualified staff and not solely by automated means. If a complaint shows that our decision was wrong, we will reverse it without undue delay.
20.5 Out-of-Court Dispute Settlement
If you are in the European Union, you may also refer a dispute about our decision to an out-of-court dispute settlement body certified under Article 21 of the DSA. We will engage in good faith with the body you select, although its decisions are not binding on us. Using this option does not affect your right to go to court.
20.6 Trusted Flaggers and Misuse
We handle reports from trusted flaggers designated under the DSA with priority. After a prior warning, we may suspend for a reasonable period the processing of reports and complaints from anyone who frequently submits manifestly unfounded ones, and may suspend the accounts of users who frequently provide manifestly illegal content.
20.7 Removal of Non-Consensual Intimate Images
If an intimate image or video of you, including a realistic AI-generated one, has been published on the Services without your consent, you, or a person authorized to act for you, can ask us to remove it using our online removal form, if we offer one, or by email to abuse@superx.sg (no account is needed). Your request should identify the image or video and where it appears, include a brief statement that you believe in good faith it was published without your consent, and include your contact details and your physical or electronic signature. We will give you a reference number. Within 48 hours of receiving a valid request, we will remove the image or video and make reasonable efforts to find and remove known identical copies, as required by the U.S. TAKE IT DOWN Act.
20.8 Singapore Online Safety
We comply with directions and orders issued by the Online Safety Commission and other competent authorities in Singapore, including under the Online Safety (Relief and Accountability) Act 2025, which may require us to remove or restrict content or accounts or to provide information.
20.9 Points of Contact
Users can contact us about the Services at support.ai@superx.sg or +65 6493 0066; this is our single point of contact for users under Article 12 of the DSA. Authorities of the EU Member States, the European Commission, and the European Board for Digital Services can contact us at legal@superx.sg, our single point of contact under Article 11 of the DSA. Reports of illegal content should be made as described in Section 20.2. We accept communications in English and, once we have designated a legal representative in the European Union, in an official language of the Member State where it is established. Where the law requires us to designate a legal representative in the European Union under Article 13 of the DSA, we will publish their contact details on this page.

SuperX AI: aicloud.superx.sg and the SuperX-AI app at aicloud.superx.sg/ai-apps
Last Updated: September 28, 2026 | Version 1.0
https://aicloud.superx.sg/terms
Introduction
This Content and Community Policy (this “Policy”) is issued by SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore with its registered office at 30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440 (“SuperX”, “we”, “us” or “our”).
This Policy covers SuperX AI. That means the model marketplace, the SuperX AI API, AI applications and the SuperX-AI app at aicloud.superx.sg/ai-apps, including the creative canvas and other content creation tools, the video and story creation tools and the public gallery (the “Gallery”) (together, “SuperX AI”). It sets out what you may and may not create, upload, generate, publish or share on SuperX AI, how to report content, and how we moderate content and enforce this Policy. It also explains how you can challenge our decisions.
This Policy forms part of the SuperX AI Terms of Use (https://aicloud.superx.sg/terms) and is governed by the laws of Singapore and subject to the dispute resolution provisions of those Terms of Use, without limiting the rights described in Section 9. It includes the information about content moderation that we provide under the EU Digital Services Act (Regulation (EU) 2022/2065, the “DSA”). It also sets out the notice-and-removal process required by the US TAKE IT DOWN Act.
1. Scope and how we moderate
1.1 What this Policy covers. This Policy applies to:
-
Inputs: prompts, instructions, scripts, reference images, audio, video, files and other material you submit;
-
Outputs: text, images, video, audio, code and other content generated for you;
-
Published Content: anything you make available to other people through SuperX AI, including, where these features are offered, Gallery posts, shared canvases and projects, reusable prompts, workflows and similar items, profile information and comments; and
-
your conduct on or through SuperX AI, including how you use Outputs elsewhere.
1.2 Private content is covered too. Sections 2 and 3 apply to private Inputs and Outputs as well as to Published Content. Section 4 applies only to Published Content.
1.3 Other rules. The usage policies of model providers, described in the Model Terms and Provider Disclosures (https://aicloud.superx.sg/terms), may be stricter than this Policy for particular models. Where they are, the stricter rule applies. Content is prohibited if it is illegal in the country where you are, where it is published or accessed, or in Singapore. We may also restrict content that is lawful in some places.
1.4 How we moderate. We combine three things:
-
automated tools, such as classifiers that screen Inputs and Outputs, keyword and pattern filters, spam and abuse detection and, where available, hash-matching against known child sexual abuse material and non-consensual intimate images;
-
human review by trained personnel; and
-
reports from users and others, and notices and orders from trusted flaggers and authorities.
Automated tools may block a request or withhold an Output when it is generated. Decisions on complaints are taken under the supervision of qualified staff and not solely by automated means. We take context into account, such as educational, documentary, scientific, artistic, satirical and newsworthy purposes. Context never excuses content described in Sections 2.1 to 2.3.
1.5 No general monitoring. We do not pre-screen all content and have no general obligation to monitor it. If we leave content up, that does not mean we approve of it.
2. Prohibited content and conduct
You must not use SuperX AI to create, request, upload, generate, publish, share or promote the content or conduct described below. The examples are illustrative, not exhaustive. Trying to generate prohibited content breaches this Policy even if our systems block it.
2.1 Child sexual abuse and exploitation (zero tolerance)
We prohibit any content that sexualizes or exploits minors (anyone under 18). This applies whether the content is real, AI-generated, drawn, animated or otherwise synthetic (“virtual”), and whatever the claimed age or fictional setting. Examples:
-
child sexual abuse material (CSAM), including AI-generated or altered images, video or audio;
-
sexualized depictions or descriptions of minors, including in text or role-play, and childlike or “age-regressed” depictions in sexual contexts;
-
“nudifying” or sexualizing images of real children, or using images of real children as references for sexual content; and
-
grooming, sextortion or solicitation of minors, and content that advertises, normalizes or gives instructions for child sexual abuse.
Enforcement. We remove the content and preserve relevant information as the law requires. We permanently terminate the accounts involved without warning. We report to the competent authorities and designated reporting organizations, as required or permitted by law. We do not reinstate these accounts unless our review of a complaint shows that we made a mistake.
2.2 Non-consensual intimate imagery and sexual deepfakes
We prohibit:
-
sharing, or threatening to share, intimate images or video of a real person without that person’s consent;
-
creating or sharing nude or sexually explicit depictions of a real, identifiable person that are generated or altered by AI (“sexual deepfakes”), including of public figures and whatever consent is claimed;
-
“nudify”, “undress” or face-swap prompts, tools or workflows aimed at real people; and
-
sextortion, meaning threats to share intimate content unless demands are met.
Anyone can ask us to remove this content through the priority process in Section 6. We remove it within 48 hours of a valid request.
2.3 Non-consensual likeness, voice cloning and impersonation
We prohibit:
-
creating or publishing realistic images, video or audio of a real, identifiable person without their consent. This includes a voice clone, or a consistent character based on the person’s face, body or voice. It does not include clearly labeled satire, parody or commentary about a public figure that is not sexual, not defamatory and not likely to be taken as real (see also Section 2.9 on elections);
-
using video and story creation tools, or character or avatar tools, to cast real people, such as colleagues, classmates or former partners, without their consent;
-
impersonating any person, brand, organization, public authority or SuperX, including through fake profiles, cloned voices in calls or messages, or false claims of affiliation; and
-
fake endorsements or testimonials that use real people’s names, images or voices.
If you are the person depicted, you can ask us to remove the content using Section 5.
2.4 Harassment, bullying, doxxing and hate
We prohibit:
-
threats, intimidation, stalking, and content intended to shame, degrade or frighten a specific person;
-
encouraging others to harass someone, and coordinated harassment;
-
doxxing: publishing private information, such as a home address, phone number, identity number, private photos, workplace or location, to harass, expose or endanger someone;
-
content that attacks, dehumanizes, or incites discrimination, hostility or violence against people because of race, ethnicity, national origin, caste, religion, disability, serious disease, sex, gender identity, sexual orientation, age or another protected characteristic; and
-
content that promotes hostility between racial or religious groups, including content prohibited by Singapore law.
2.5 Violent extremism and terrorism
We prohibit:
-
content that praises, supports, promotes, represents or recruits for terrorist or violent extremist organizations or individuals, including those designated by the United Nations, Singapore, the United States, the European Union or the United Kingdom;
-
manifestos, propaganda, recruitment or fundraising material for such groups, and content that glorifies terrorist attacks or their perpetrators; and
-
instructions, planning or operational support for attacks.
News reporting, documentary, academic and counter-extremism content may be allowed where it clearly does not promote the group or the act.
2.6 Violence and self-harm
We prohibit:
-
incitement to violence, credible threats, and glorification of real-world violent acts or mass-casualty events; and
-
content that promotes, encourages or gives instructions for suicide, self-harm or eating disorders, including “challenges”.
Safe-messaging exception. We allow content that discusses personal experience of self-harm or mental health, recovery, prevention or seeking help, or that raises awareness, if it follows recognized safe-messaging practice. That means, for example, no method details and no glamorization. We may show support resources. If someone is at immediate risk, contact local emergency services.
2.7 Weapons, CBRN and dangerous activities
We prohibit providing meaningful help (“uplift”) for the following:
-
developing, producing, acquiring, modifying, stockpiling or using chemical, biological, radiological or nuclear weapons. This includes synthesis routes for chemical warfare agents or toxins, methods to culture, enhance or weaponize dangerous pathogens, and ways to obtain restricted materials or evade biosecurity controls;
-
making explosives or improvised explosive devices, or unlawfully making, converting or acquiring firearms or ammunition, including untraceable, 3D-printed or fully automatic weapons; and
-
attacks on critical infrastructure such as power, water, transport or healthcare systems.
General educational, historical and policy discussion is allowed where it does not provide actionable uplift.
2.8 Cyber-offense and malicious code
We prohibit:
-
creating, improving or distributing malware, ransomware, spyware, stalkerware, keyloggers, botnets or cryptojacking code;
-
developing exploits for, or gaining or attempting unauthorized access to, systems, accounts or data you are not authorized to test;
-
phishing kits, credential harvesting and denial-of-service tools; and
-
using SuperX AI to automate attacks or to evade security controls, including SuperX’s own.
Defensive security work, education, and authorized testing of systems you own or have permission to test are allowed. Security research on SuperX itself must follow our Vulnerability Disclosure Policy (https://aicloud.superx.sg/terms).
2.9 Fraud, scams, deception and election integrity
We prohibit:
-
scams and fraud, including phishing, investment, cryptocurrency, romance, job, loan and fake-giveaway scams, and advance-fee fraud;
-
forged or counterfeit documents, such as identity documents, receipts, invoices, certificates, medical notes or bank statements, and counterfeit currency;
-
deceptive deepfakes: realistic synthetic images, audio or video of real people, places or events that are presented as genuine, or likely to be taken as genuine, in order to deceive, defraud or cause harm. Examples include fake statements by officials, fabricated news footage and fake evidence;
-
harmful misinformation, such as false health claims likely to cause physical harm, or false emergency information;
-
election and political manipulation, including:
-
false information about how, when or where to vote, or who can vote, and content designed to suppress voting;
-
impersonating candidates, parties, election officials or public authorities;
-
covert or coordinated influence operations, including foreign interference; and
-
AI-generated political advertising without the disclosure the law requires;
-
in Singapore, during an election period, publishing or sharing online election advertising that contains digitally generated or manipulated content realistically depicting a candidate saying or doing something they did not say or do, which the Parliamentary Elections Act 1954 and the Presidential Elections Act 1991 (as amended by the Elections (Integrity of Online Advertising) (Amendment) Act 2024) prohibit; and
-
content that breaches a direction issued under the Protection from Online Falsehoods and Manipulation Act 2019 or the Foreign Interference (Countermeasures) Act 2021.
SuperX may restrict or prohibit political advertising and campaign content on SuperX AI.
2.10 Regulated goods and services
We prohibit content that sells, buys, promotes or facilitates:
-
illegal drugs or controlled substances, or prescription medicines without authorization;
-
weapons, ammunition, explosives or their parts, where unlawful;
-
human trafficking, forced labor, or sexual services or exploitation;
-
unlicensed gambling, financial services or investment solicitations;
-
counterfeit or stolen goods, or stolen data or payment credentials;
-
other goods or services that are restricted or banned where offered; or
-
evasion of sanctions or export controls, including helping Restricted Parties, or persons in Restricted Jurisdictions, to obtain restricted items, technology or services (see the Export Compliance Terms at https://aicloud.superx.sg/terms).
2.11 Privacy violations
We prohibit:
-
collecting, processing or disclosing personal data without a lawful basis, including scraping personal data or building profiles or dossiers on individuals;
-
covert surveillance, tracking or monitoring of a person without their consent or legal authority;
-
identifying people from images, audio or video by facial or voice recognition, or inferring sensitive characteristics about identifiable people (such as health, sexual orientation, religion or political views), without a lawful basis;
-
sharing private communications, or medical, financial or other sensitive records of others, without authorization; and
-
practices prohibited by Article 5 of the EU Artificial Intelligence Act. Examples are social scoring, untargeted scraping of facial images to build facial recognition databases, emotion recognition in workplaces or schools (other than for medical or safety reasons), biometric categorization to infer sensitive characteristics, and manipulative or exploitative techniques that cause significant harm.
2.12 Intellectual property infringement
We prohibit:
-
content that infringes copyright, trademarks, design rights, trade secrets or other intellectual property rights;
-
prompts or workflows designed to reproduce protected works verbatim or near-verbatim (for example, full song lyrics, book chapters or film scenes), or to reproduce protected characters, logos or brands in an infringing way;
-
removing or altering copyright management information, watermarks or other rights information, and circumventing technical protection measures; and
-
distributing pirated content or links to it.
Intellectual property complaints are handled under our Copyright and Intellectual Property Policy (https://aicloud.superx.sg/terms). Send them to copyright@superx.sg.
2.13 Spam, platform manipulation and inauthentic behavior
We prohibit:
-
bulk or repetitive unsolicited content, content farms, and low-quality mass uploads;
-
artificially inflating views, likes, clones, follows or rankings, or otherwise manipulating the Gallery or recommendations, including through bots, scripts, paid engagement or coordinated networks;
-
creating multiple or fake accounts, or using other people’s accounts, to evade limits or enforcement, or to abuse promotional credits, referral schemes or free trials;
-
misleading titles, thumbnails, tags or metadata, and bait-and-switch content;
-
distributing malware, malicious links or deceptive redirects (see also Section 2.8); and
-
coordinated inauthentic behavior.
2.14 Sexually explicit content and graphic violence
Sexually explicit content. SuperX AI does not permit pornographic or sexually explicit content, including explicit text, to be generated, uploaded, published or shared anywhere on SuperX AI. Non-sexual nudity in a clearly artistic, educational, medical or scientific context may be allowed in private workspaces, but must not be published in the Gallery. SuperX may restrict or prohibit adult or suggestive content further at any time.
Graphic violence. Fictional and dramatic violence in creative works, including AI-generated videos and stories, is allowed within limits. We prohibit:
-
gratuitous or sadistic gore, torture or mutilation;
-
sexual violence;
-
depictions of real victims of violence, accidents or disasters that degrade them; and
-
real footage of violent acts shared to glorify them or to shock.
Published Content with strong violence may be restricted, labeled or excluded from recommendations.
2.15 Content targeting or harmful to minors
SuperX AI is only for adults (18+). We prohibit:
-
content directed at children that is sexual, violent or frightening, or that promotes dangerous acts or age-restricted products;
-
content designed to contact or befriend children, or to collect their personal data;
-
realistic AI-generated depictions of real, identifiable children in Published Content, even if non-sexual; and
-
accounts created by or for anyone under 18. We close accounts that we reasonably believe belong to minors.
2.16 Other illegal content
We prohibit any other content or activity that is illegal where you are, where it is published or accessed, or under Singapore law. Examples include defamation, contempt of court, content that breaches a court order, and illegal hate speech.
3. AI transparency: labels, watermarks and disclosure
3.1 Our labels. SuperX may add visible labels (such as “AI-generated”), invisible watermarks and machine-readable provenance metadata to Outputs, or use other labeling technologies. It may also label Published Content as AI-generated. We do this to help people recognize AI-generated content and to comply with laws such as Article 50 of the EU Artificial Intelligence Act, which applies from 2 August 2026. Model providers may add their own labels too.
3.2 Do not remove them. You must not remove, alter, obscure or strip labels, watermarks or provenance metadata. You must not use tools designed to do so, or present Outputs as human-made where that would mislead.
3.3 Disclose when you publish or distribute. When you publish or distribute Outputs, including outside SuperX AI:
-
clearly disclose that content is AI-generated or manipulated if it is a deepfake, meaning realistic image, audio or video content that resembles real people, objects, places, entities or events and could falsely appear authentic;
-
for evidently artistic, creative, satirical or fictional works, such as AI-generated videos and stories, you may make that disclosure in a way that does not spoil the work, for example in the credits, description or a caption;
-
if you publish AI-generated text to inform the public on matters of public interest, disclose that it is AI-generated, unless a person has reviewed it and takes editorial responsibility for it; and
-
follow any other disclosure rules that apply to you, such as rules on political advertising, and the rules of the platforms where you post.
3.4 Chatbots and agents. If you use SuperX AI to build a chatbot, agent or other system that interacts with people, you must tell them they are interacting with AI where the law requires it, unless that is obvious.
4. Publishing and the Gallery
4.1 About the Gallery. The Gallery is a public space. Users can publish works together with their prompts, workflows, canvas projects or similar items. Other users can view them and, where permitted, clone prompts and recreate works. What other users may do with your Published Content is set out in the Terms of Use. For works in the creator program, it is set out in the SuperX-AI Creator License Agreement (https://aicloud.superx.sg/terms).
4.2 Gallery rules. In addition to Section 2, when you publish you must:
-
publish only content you have the right to publish and license as described in the Terms of Use and, where applicable, the Creator License Agreement;
-
keep the AI-generated label, and not misrepresent how the content was made;
-
not publish sexually explicit content, realistic depictions of real people without their consent, or depictions of real children;
-
not include other people’s personal data, including in prompts;
-
use accurate titles, descriptions, tags and categories, and mark content with strong violence or other sensitive themes using the settings provided, where available;
-
not publish advertising, promotions or solicitations unless we allow it, and declare any commercial content (such as sponsored or paid content) using the tools provided, where available;
-
not publish prompts or workflows designed to bypass safety systems (“jailbreaks”) or to generate prohibited content; and
-
credit original creators when you remix, where the product supports it, and not repost other people’s works as your own.
4.3 Review and visibility. We may review Published Content before or after publication. We may decline to publish it or remove it. We may restrict its visibility, for example by excluding it from recommendations, search or the Gallery. We may also disable cloning or add labels or warnings.
4.4 How the Gallery is ordered. We use automated recommender systems to decide which Published Content appears in the Gallery and in what order. The main parameters are:
-
Popularity: signals such as how many views, likes, saves and clones a work receives;
-
Recency: how recently a work was published or updated;
-
Engagement: how users interact with a work relative to how often it is shown, such as its click-through or clone rate;
-
Editorial curation: our team may feature works in collections, campaigns or featured sections;
-
Safety and quality filtering: content that may breach this Policy, spam, duplicates and low-quality items are excluded or ranked lower; and
-
Your settings: any language, region or category filters you choose, where available.
Relative importance. In views that show trending or popular works, popularity and engagement matter most, weighted toward recent activity, because they reflect what users currently find useful. In views that show the latest works, recency is the main parameter. Featured sections are chosen editorially. Safety and quality filtering applies to every view.
Personalization. If we personalize the Gallery based on your individual activity or profile, we will describe its parameters and your options here.
How you can influence what you see. You can use the controls available in the Gallery, which may include switching between views (such as trending and latest works), filtering by category, searching, hiding works or marking them “not interested”, and reporting content. Creators help their works be found by using accurate titles, tags and categories. Any paid or sponsored placement will be labeled.
5. Reporting content
5.1 How to report. You can report content that you believe is illegal or breaches this Policy:
-
in the product, using the “Report” option where available, such as on Gallery items, profiles and shared content;
-
using our online reporting form, if we offer one (no SuperX AI account is needed); or
-
by email to abuse@superx.sg.
Some matters have their own route:
-
intellectual property: the Copyright and Intellectual Property Policy (copyright@superx.sg);
-
intimate images: Section 6;
-
security vulnerabilities: the Vulnerability Disclosure Policy (security@superx.sg); and
-
requests from authorities: the Law Enforcement and Government Request Policy (https://aicloud.superx.sg/privacy).
5.2 What to include. To help us act quickly, and for notices of illegal content under Article 16 of the DSA, please include:
-
a sufficiently substantiated explanation of why you believe the content is illegal or breaches this Policy, naming the law concerned where you can;
-
the exact location of the content, such as its URL, Gallery link or share link, and any other information we need to identify it;
-
your name and email address (you may report content you believe involves child sexual abuse anonymously); and
-
a statement that you believe in good faith that the information and allegations in your report are accurate and complete.
5.3 What happens next. We acknowledge your report without undue delay and give you a reference number. We review reports in a timely, diligent, non-arbitrary and objective way. We give priority to reports involving risks to life, child safety, intimate images and terrorist content. We tell you our decision and our reasons, and how you can challenge the decision. We also tell you if we used automated means to process your report or reach the decision.
5.4 Threats to life or safety. We may learn of information that gives rise to a suspicion that a criminal offense threatening someone’s life or safety has taken place, is taking place or is likely to take place. If so, we promptly inform the relevant law enforcement or judicial authorities, as Article 18 of the DSA requires and as otherwise permitted by law. If someone is in immediate danger, contact local emergency services first.
6. Non-consensual intimate images: priority removal
6.1 This process implements the US TAKE IT DOWN Act. It is open to anyone, wherever they are.
6.2 Who can ask. You can ask if you are the person shown in an intimate image or video published on SuperX AI without your consent, including one that is AI-generated or digitally altered. Someone authorized to act for that person can also ask.
6.3 How to ask. Email abuse@superx.sg with the subject “Intimate Image Removal Request”, or use our intimate image removal form if we offer one. You do not need a SuperX AI account.
6.4 What to include. A valid request contains:
-
your physical or electronic signature (for example, your typed full name);
-
information reasonably sufficient for us to identify and locate the image or video, such as a URL or share link;
-
a brief statement that you believe in good faith that the image or video was published without the consent of the person shown, with any information that helps us confirm this; and
-
contact details for you, or for the person acting for you.
6.5 What we do.
-
We give you a reference number when we receive your request.
-
As soon as possible, and in any event within 48 hours after we receive a valid request, we remove the image or video and make reasonable efforts to find and remove known identical copies on SuperX AI.
-
We may use hash-matching to prevent re-uploads.
-
We take action against the accounts involved (see Section 8.4).
-
We ask only for the information needed to handle your request, and we treat it confidentially in line with our Privacy Policy (https://aicloud.superx.sg/privacy).
6.6 Knowingly false or abusive requests may lead to action under Section 8.6.
7. Trusted flaggers, authorities and legal orders
7.1 Trusted flaggers. Trusted flaggers are designated under Article 22 of the DSA. We give their notices priority, and decide them without undue delay, where the notice falls within their designated area of expertise and comes through abuse@superx.sg with the subject “Trusted Flagger Notice”.
7.2 EU authority orders. National judicial or administrative authorities in the EU may order us to act against specific illegal content (Article 9 of the DSA) or to provide information about specific users (Article 10). We tell the issuing authority, without undue delay, how we have acted on the order. We also inform the affected users as required, subject to any delay or confidentiality that the authority lawfully requires. Authorities, the European Commission and the European Board for Digital Services can reach our single point of contact (Article 11) at legal@superx.sg, in English and, once we have designated a legal representative in the European Union, in an official language of the Member State where it is established. Where the law requires us to designate a legal representative in the European Union (Article 13), we will publish their contact details on this page.
7.3 Singapore. We comply with the directions and orders under Singapore law that apply to us. These include directions of the Online Safety Commission under the Online Safety (Relief and Accountability) Act 2025 and directions under the Protection from Online Falsehoods and Manipulation Act 2019 (such as correction, stop communication, disabling and account restriction directions). They also include directions under the Online Criminal Harms Act 2023 and directions issued during elections.
7.4 Other authorities. We assess requests and orders from other authorities under our Law Enforcement and Government Request Policy.
7.5 Territorial scope. Where an order, or the law, requires us to restrict content only in a particular country, we may limit the restriction to that country.
8. Enforcement
8.1 Measures. Depending on how serious the case is, we may take one or more of these measures:
-
a warning;
-
blocking a request or withholding an Output;
-
removing or disabling access to content;
-
restricting visibility, for example by demoting content, excluding it from recommendations, search or the Gallery, adding sensitivity labels or disabling cloning;
-
limiting features, such as publishing, sharing, cloning, commenting, API access, specific models or rate limits;
-
suspending or ending participation in the creator program or any monetization;
-
suspending an account temporarily;
-
terminating an account, and barring the user from creating new ones; and
-
reporting to law enforcement or other authorities.
8.2 How we decide. Our measures are proportionate. We consider how serious the violation is, the harm caused or risked, and whether the content is illegal. We also consider intent and context, whether the content was private or published, your history, and whether you took steps to fix the problem.
8.3 Strikes. Violations that do not lead to immediate termination count as strikes:
-
first strike: a warning and removal of the content;
-
second strike within 90 days: feature limits for up to 7 days;
-
third strike within 90 days: account suspension for up to 30 days; and
-
further violations: termination.
Strikes expire 12 months after they are issued. Repeat copyright infringement is handled under the Copyright and Intellectual Property Policy.
8.4 Immediate termination. We may terminate an account immediately, without prior warning, where the law requires it or for any of the following:
-
child sexual abuse material or sexualization of minors;
-
non-consensual intimate images or sexual deepfakes of real people;
-
terrorist or violent extremist content, or credible threats of violence;
-
meaningful help with CBRN weapons or other weapons;
-
serious fraud, or evasion of sanctions or export controls; or
-
attacks on the systems of SuperX or other users.
8.5 Statement of reasons. If we remove or restrict your content, or restrict your account, we tell you (as Article 17 of the DSA requires):
-
what we did, including its scope, duration and, where relevant, territorial scope;
-
the facts and circumstances we relied on, including whether we acted on a notice or on our own initiative;
-
whether we used automated means;
-
the legal ground relied on (for illegal content) or the provision of our terms relied on (for policy violations), with an explanation; and
-
how you can challenge the decision, through internal complaints, out-of-court dispute settlement or the courts.
We may not give a statement where we do not have your contact details, or where the content is deceptive high-volume commercial content. We may also withhold or delay one where an authority or the law requires it.
8.6 Misuse. In line with Article 23 of the DSA, after a prior warning:
-
we suspend, for a reasonable period, accounts that frequently provide manifestly illegal content; and
-
we suspend, for a reasonable period, the processing of notices and complaints from individuals or entities that frequently submit manifestly unfounded ones.
We decide case by case. We consider the number of manifestly illegal items, or manifestly unfounded notices, in a given period, and their proportion of the total. We also consider how serious the misuse is and its consequences, and, where we can identify it, the intention behind it. Content or a notice is “manifestly” illegal or unfounded where this is evident to a layperson without detailed analysis. A first suspension under this Section lasts 30 days and a later one 90 days.
8.7 Human oversight. All decisions on complaints are taken under the supervision of qualified staff and not solely by automated means. We use automated tools mainly to detect and block content when it is generated and to prioritize reports.
8.8 Preservation. We may preserve content and account information where the law requires or permits it, for example for investigations or legal proceedings.
9. Complaints, appeals and dispute settlement
9.1 Internal complaints. You can complain about any of these decisions:
-
removing or restricting your content;
-
suspending or terminating your account;
-
suspending or ending your participation in the creator program or any monetization; or
-
not acting on your report.
Complain through the link in our notice or in the product, where available, or by email to abuse@superx.sg with your reference number. You can do so for at least 6 months after we tell you about the decision. Complaints are free. Explain why you think the decision was wrong. Qualified staff review every complaint, so decisions are never made solely by automated means. If the decision was wrong, we reverse it without undue delay. We tell you the outcome and any further options you have.
9.2 Out-of-court dispute settlement (EU). If you are in the EU, you can refer the dispute to any out-of-court dispute settlement body certified under Article 21 of the DSA. We engage in good faith with the body you choose, although its decisions do not bind us. We may decline to engage if a dispute about the same content and the same grounds has already been resolved. If the body decides in your favor, we pay its fees and reimburse your reasonable expenses. If it decides in our favor, you do not have to reimburse our fees or expenses unless the body finds that you acted manifestly in bad faith.
9.3 UK users. If you are in the United Kingdom, you can also use the channels above to complain about content you consider illegal, or about how we comply with the Online Safety Act 2023, to the extent it applies to us.
9.4 Singapore users. If you have reported certain online harms to us (such as harassment, intimate image abuse, image-based child abuse, doxxing or impersonation), you may also be able to seek help from the Online Safety Commission under the Online Safety (Relief and Accountability) Act 2025.
9.5 Courts. Nothing in this Section limits your right to go to court.
10. Law enforcement cooperation
We respond to valid legal process and emergency requests in line with our Law Enforcement and Government Request Policy (https://aicloud.superx.sg/privacy). We report apparent child sexual abuse material to the competent authorities and designated reporting organizations, as required or permitted by law, and preserve related information as required. We may also refer other serious crimes and threats to the authorities.
11. Transparency reporting
We will publish information about our content moderation to the extent, in the form and at the intervals that the DSA (Articles 15 and 24) and other applicable laws require. This includes the numbers of notices and orders we receive, the measures we take, complaints and their outcomes, our use of automated tools and our median handling times. We may also publish information about government requests.
12. Changes to this Policy
We may update this Policy under the change provisions of the Terms of Use. We give at least 15 days’ notice of material changes that restrict what you can do. Changes required by law, or needed urgently to address safety risks or abuse, may take effect immediately. We will tell you about significant changes in the product or by email.
13. Contact and points of contact
-
Point of contact for users (DSA Article 12): support.ai@superx.sg or +65 6493 0066. You can reach a person; we do not rely only on automated tools.

SuperX Vulnerability Disclosure Policy
SuperX AI Pte. Ltd.
SuperX AI (aicloud.superx.sg and the SuperX-AI app at aicloud.superx.sg/ai-apps)
Last Updated: September 28, 2026 | Version 1.0
Introduction
This Vulnerability Disclosure Policy (this “Policy”) is issued by SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore with its registered office at 30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440 (“SuperX”, “we”, “us” or “our”).
It covers SuperX AI (aicloud.superx.sg and the SuperX-AI app at aicloud.superx.sg/ai-apps) (the “Services”).
We welcome reports from security researchers who find vulnerabilities in the Services. This Policy explains what is in scope, the rules you must follow when testing, how to report and what to expect from us. It also explains the conditions on which we will treat your research as authorized.
1. Scope
1.1 In scope. Only systems that SuperX owns and operates are in scope:
-
https://aicloud.superx.sg, including the model marketplace and the SuperX AI API; and
-
https://aicloud.superx.sg/ai-apps, including the creative canvas and other content creation tools, and the public gallery.
1.2 Your own resources only. You may test only accounts, API keys and resources that you own or have the account holder’s explicit written permission to test. Where possible, use accounts created for testing and identify yourself in your report.
1.3 Infrastructure and isolation testing. Tenant-isolation weaknesses are in scope, for example access between customers’ virtual machines, storage or networks. You must test them only against resources in your own accounts, and stop at the first evidence of cross-tenant access. Testing of hypervisors, firmware, baseboard management controllers or physical hosts requires our prior written approval.
1.4 Out of scope. The following are out of scope and not authorized:
-
denial-of-service attacks, load or stress testing, resource exhaustion, and any testing that degrades availability for others;
-
social engineering of any kind (including phishing, vishing and pretexting) aimed at SuperX personnel, contractors, customers or users;
-
physical attacks on offices, data centers or hardware;
-
third-party services and providers, such as payment service providers, third-party sign-in services, model providers’ APIs, email services and hosting or network providers. Report issues in those services to the third party under its own program. We accept reports about how we configure or integrate them;
-
other customers’ or users’ accounts, data or resources;
-
output from automated scanners with no demonstrated security impact;
-
missing best practices with no demonstrated impact, such as missing security headers, email authentication records, clickjacking on pages without sensitive actions, version disclosure, self-XSS or logout cross-site request forgery;
-
issues that need physical access to a device, a compromised device or browser, or an unsupported browser;
-
brute-force, credential-stuffing or account-enumeration testing; and
-
model behavior with no security impact. This includes jailbreaks, prompt injection that does not cross a security boundary, harmful or inaccurate outputs, and bias. Report safety or content issues to abuse@superx.sg. Model red-teaming beyond normal use requires our prior written approval.
1.5 AI-related issues are in scope where they have a security impact. Examples are prompt injection that exposes another user’s data, triggers unauthorized tool or workflow actions, or bypasses access controls or Custom Data Policies.
2. Rules of engagement
When testing, you must:
-
not exfiltrate data. Do not access, download, copy, modify or delete data beyond the minimum needed to demonstrate the vulnerability. If you come across personal data, customer data, credentials or secrets, stop, do not keep them, and tell us immediately;
-
not persist. Do not install backdoors or web shells, maintain access, pivot to other systems or move laterally;
-
stop at proof. Use the least intrusive proof of concept, and stop once you have established the vulnerability;
-
not violate privacy. Do not view, alter or disclose other people’s information, and do not interact with other users’ accounts;
-
not disrupt. Do not degrade the Services or other users’ experience, and do not send spam or unsolicited messages;
-
not exploit or extort. Do not use a vulnerability for any purpose other than verifying it. Do not make a report conditional on payment. We do not accept conditional reports and may refer demands to the authorities;
-
keep it confidential until disclosure is coordinated under Section 6;
-
delete data you obtained during testing after reporting, and confirm the deletion to us on request; and
-
comply with the law and our terms: applicable law, including export control and sanctions laws, and our terms, including the Content and Community Policy (https://aicloud.superx.sg/terms), except as Section 5 expressly permits.
3. How to report
3.1 Email security@superx.sg. Please include:
-
the affected asset, URL, endpoint or resource;
-
a description of the vulnerability and its potential impact;
-
step-by-step instructions to reproduce it, with a proof of concept, screenshots or request and response samples;
-
the accounts, resource IDs, IP addresses and dates and times used in testing; and
-
your name or handle and contact details, and whether you would like public acknowledgment.
3.2 Please write in English and send one vulnerability per report where possible. Do not include other people’s personal data or secrets in your report, even in encrypted form. Describe them instead.
3.3 This address is for security reports only. Support requests go to support.ai@superx.sg, and requests from authorities go to legal@superx.sg.
4. What to expect from us
-
We aim to acknowledge receipt within 3 business days.
-
We aim to give an initial assessment, including whether the report is in scope, within 10 business days.
-
We aim to give status updates at least every 30 days until the issue is resolved.
-
We aim to fix validated vulnerabilities within a reasonable time that depends on their severity, which we assess using industry-standard severity ratings (such as the Common Vulnerability Scoring System) and our own judgment.
-
We tell you when the issue is fixed and coordinate disclosure with you (Section 6).
-
With your agreement, we may publicly acknowledge your contribution.
We may need to share your report with affected third parties, such as software vendors, model providers or affected customers, to coordinate a fix. We will not share your personal details without your consent unless the law requires it.
5. Safe harbor
5.1 Authorization. If you make a good-faith effort to comply with this Policy, we will treat your research as authorized, to the extent SuperX can authorize access to systems it owns and operates. That includes authorization for the purposes of the Computer Misuse Act 1993 of Singapore, the US Computer Fraud and Abuse Act (18 U.S.C. §1030) and similar laws.
5.2 No legal action by SuperX. For research conducted in good faith and in compliance with this Policy, we will not bring, or support, civil action or a criminal complaint against you. That covers computer-misuse laws and anti-circumvention laws for circumventing technology measures that protect the in-scope Services. For that limited purpose, we also waive the provisions of our terms that would otherwise prohibit the research.
5.3 Third parties. If a third party takes legal action against you for research that complied with this Policy, we will, on request, make it known that your research was authorized by us.
5.4 Limits. This safe harbor:
-
applies only to systems that SuperX owns and operates. SuperX cannot authorize access to third-party systems, customer workloads or model providers’ services;
-
does not bind third parties, including other customers, providers and partners;
-
does not bind public authorities, including the police, prosecutors and regulators, and cannot waive any criminal law;
-
does not apply if you breach this Policy, act in bad faith, attempt extortion, or access or retain more data than necessary; and
-
does not affect any obligation we have to notify regulators or affected individuals of a data breach. If your research reveals that personal data was exposed, we may have to report it, and you must help us by confirming what you accessed and that you have deleted it.
5.5 If you are unsure whether an activity is allowed, ask us at security@superx.sg before you proceed.
6. Coordinated disclosure
6.1 Please give us a reasonable opportunity to fix a vulnerability before you disclose it. You may publish details after 90 days from the date of your report, or earlier if we agree. We will try to fix issues well within that period.
6.2 If a fix needs more time, for example because it depends on a third-party vendor, we may ask you to agree an extension. If a vulnerability is being actively exploited, we may agree a shorter timeline with you.
6.3 Any disclosure must not include personal data, customer data, secrets or exploit details that would put users at risk. Please share a draft with us before publication.
6.4 Where appropriate, we will request CVE identifiers for vulnerabilities in our software.
7. No bounty unless announced
SuperX does not currently operate a bug bounty program. We do not offer payment, rewards or other compensation for reports unless we have publicly announced a bounty program with its own terms. Any acknowledgment or token of thanks we choose to give is discretionary and creates no obligation. Employees and contractors of the SuperX Group are not eligible for any reward.
8. Export controls, sanctions and eligibility
8.1 You must comply with applicable export control and sanctions laws when you test and report. You must not access or use the Services from a Restricted Jurisdiction or as a Restricted Party, as defined in the Export Compliance Terms (https://aicloud.superx.sg/terms).
8.2 Restricted Jurisdictions currently include Cuba, Iran, North Korea, Crimea, the so-called Donetsk and Luhansk People’s Republics and other areas of Ukraine not under the control of the Ukrainian government, Russia, Belarus and Syria. The Export Compliance Terms may change this list.
8.3 No reward, monetary or in kind, may be given to any person who is a Restricted Party, or to any person located, organized or ordinarily resident in a Restricted Jurisdiction. This applies even if a bounty program is later announced. We may be unable to engage with reports from such persons.
8.4 Do not send us export-controlled technical data in a report.
9. Your report and our use of it
9.1 By submitting a report, you give SuperX a perpetual, worldwide, royalty-free, irrevocable license to use, reproduce and share it to investigate, fix and prevent vulnerabilities, including by sharing it with affected third parties as described in Section 4. You confirm that you have the right to submit it.
9.2 We process personal data in reports in line with our privacy policies: https://aicloud.superx.sg/privacy.
9.3 Except as stated in Section 5, this Policy does not change the terms that apply to your account. We may update this Policy at any time. The version published when you carry out your research applies to that research.
9.4 This Policy is governed by the laws of Singapore. This does not affect any mandatory rights you have under the law that applies to you.

8. Termination
Terms of Use
24. Suspension and Termination
You may stop using the Services and close your account at any time through your account settings or by contacting support.ai@superx.sg.
We may suspend or restrict your access to all or part of the Services, and may terminate your account, if:
-
You materially violate these Terms;
-
You engage in fraud or abuse;
-
Your use creates a security risk;
-
Your use violates applicable law;
-
Payment obligations remain unpaid, or a payment is reversed or disputed;
-
We are legally required to do so, or a court or competent authority requests it;
-
A Model Provider requires us to do so, in which case the suspension may be limited to the affected model (see Section 5.6);
-
Continued access presents a material risk to SuperX or other users.
We may also terminate these Terms for convenience by giving you at least 15 days' notice, in which case you may request a refund of your unused Purchased Credits as set out in the Payments Policy.
Where reasonably practicable and lawful, we will notify you before suspending or terminating your account, and we will provide a statement of reasons as described in Section 20.3. We will act proportionately, taking into account the seriousness of the issue, and will lift a suspension once its cause has been resolved. We are not liable for any suspension or termination made in accordance with this Section to comply with law, the Export Compliance Terms, or a Model Provider's requirements.
Upon termination:
-
Your right to access the relevant Services will cease;
-
Outstanding payment obligations remain payable;
-
Unused Credits are handled as set out in the Payments Policy;
-
Sections 6.2 (during any retention period), 6.3, 7.3, 8, 14, 15, 21 to 25, and 30 to 32, and any other provisions that by their nature should survive termination, will remain effective.
25. User Content After Termination
After your account is closed or terminated, you will have 30 days to export your User Content, unless we terminated your account for a breach of Section 3 or Section 13 or the law prevents it. After that, we will delete or de-identify your User Content in accordance with our Privacy Policy, except for content that we must keep by law and content retained as described in Section 6.2. Residual copies in backups are deleted in the ordinary backup cycle within 90 days. This does not affect clones and works created by other users as described in Section 7.3.
You are responsible for maintaining appropriate backups of important User Content.
We are not responsible for loss of User Content resulting from your failure to maintain backups, except to the extent otherwise required by applicable law or a separate written agreement.
9. Privacy, DPA, and Third-Party Integrations
Terms of Use
17. Data and Privacy
SuperX is the controller of the personal data we collect in connection with your account, billing, support, security, and use of the Services, and, if you are an individual user, of your User Content. Our Privacy Policy (https://aicloud.superx.sg/privacy) describes how we collect, use, and share personal data, including which Model Providers receive it and where it is processed, and explains your rights. Our Cookie Policy (https://aicloud.superx.sg/privacy) describes our use of cookies and similar technologies. You can contact our Data Protection Officer at privacy@superx.sg.
The Privacy Policy and Cookie Policy are notices, not contract terms, and accepting these Terms does not mean that you consent to any processing for which the law requires separate consent.
If you submit personal data belonging to another person, you are responsible for ensuring that you have the necessary authorization and legal basis to do so.
If you are a Business User and we process personal data on your behalf as your processor, for example personal data in content submitted by your organization, the DPA (https://aicloud.superx.sg/privacy) applies to that processing and forms part of these Terms.
28. Third-Party Links and Services
The Services may contain links to third-party websites, applications, or services.
SuperX does not control and is not responsible for:
-
Third-party content;
-
Privacy practices;
-
Security;
-
Availability;
-
Terms of service;
-
Products or services provided by third parties.
Your use of third-party services is at your own risk and may be subject to separate terms.
10. Modification of Terms
Terms of Use
26. Changes to the Services
We may modify, update, add, or remove features from the Services.
AI models, Model Providers, pricing, consumption rates, quotas, APIs, infrastructure, and other features may change over time.
Where reasonably necessary, we may discontinue support for particular models or third-party services.
Where an enterprise agreement provides specific service commitments, those commitments will be governed by that agreement.
If we discontinue the Services as a whole, we will give you at least 15 days' notice where practicable, and you may request a refund of your unused Purchased Credits as set out in the Payments Policy.
If you are a consumer in the European Union or the European Economic Area and we change the Services in a way that negatively affects your access to or use of them, other than to a minor extent, we will tell you in advance, and you may terminate these Terms free of charge within 30 days of the change and receive a refund of your unused Purchased Credits.
27. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the “Last Updated” date.
If we make a material change that is adverse to you, we will notify you by email or through the Services at least 15 days before it takes effect. Changes required by law or for security reasons, and changes relating only to new features, may take effect immediately. Changes do not apply to any Dispute that arose before the change took effect.
If you do not agree to a change, you may close your account before it takes effect, and your unused Credits will be handled as set out in the Payments Policy. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms, to the extent permitted by applicable law.
11. Ownership

14. Intellectual Property

Subject to these Terms, SuperX grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended purposes.

You must not upload, process, generate, distribute, or use content in a manner that infringes third-party intellectual property rights.
If you believe content available through the Services infringes your copyright or other intellectual property rights, please send a notice as described in our Copyright and IP Policy (https://aicloud.superx.sg/terms) to:
with the information that the Copyright and IP Policy requires. That policy also explains how users can respond with a counter-notice.
We may remove or restrict access to allegedly infringing content where appropriate or required by law.

Introduction
This Copyright and Intellectual Property Policy (this “Policy”) is issued by SuperX AI Pte. Ltd. (UEN 202508925H), a company incorporated in Singapore with its registered office at 30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440 (“SuperX”, “we”, “us” or “our”). It applies to SuperX AI, at aicloud.superx.sg (including the model marketplace, the API and AI applications) and the SuperX-AI app at aicloud.superx.sg/ai-apps (the “Services”).
We respect intellectual property rights and expect our users to do the same. This Policy explains how to tell us about alleged infringement, how affected users can respond and how we deal with repeat infringers. It also explains how we handle trademark and other intellectual property complaints, and how we treat AI models and AI-generated content (“Outputs”).
This Policy is designed to meet the network service provider provisions of the Singapore Copyright Act 2021 and the Copyright Regulations 2021. For rights holders and users in the United States, it is also designed to meet the requirements of the US Digital Millennium Copyright Act (17 U.S.C. §512, the “DMCA”). For SuperX AI, it is also the route for intellectual property notices under the EU Digital Services Act (the “DSA”).
For users and customers, this Policy forms part of the agreement that governs your use of the Services (the “Master Agreement”). That is the SuperX AI Terms of Use (https://aicloud.superx.sg/terms). This Policy is governed by the laws of Singapore and the dispute resolution provisions of your Master Agreement. This Policy is not legal advice (see Section 11).
1. Where to send notices
1.1 Send copyright notices, counter-notices and other intellectual property complaints to our designated agent:
Copyright Agent, Legal Department
SuperX AI Pte. Ltd.
30 Pasir Panjang Road, #06-31, Mapletree Business City, Singapore 117440
Email: copyright@superx.sg
Telephone: +65 6493 0066
1.2 Email is the fastest route. Notices sent to other addresses may be delayed. This mailbox is only for intellectual property matters. Use these addresses instead for other matters:
-
other reports about content: abuse@superx.sg (see the SuperX AI Content and Community Policy at https://aicloud.superx.sg/terms);
-
support for SuperX AI: support.ai@superx.sg; and
1.3 Our designated agent for notices under the DMCA is the Copyright Agent named in Section 1.1 (copyright@superx.sg).
2. Notices of claimed infringement
2.1 What a notice must include. To be effective under the DMCA, a notice must be in writing and include:
(a) a physical or electronic signature of the copyright owner, or of a person authorized to act on the owner’s behalf;
(b) identification of the copyrighted work claimed to have been infringed. If one notice covers several works at a single site, a representative list of those works is enough;
(c) identification of the material claimed to be infringing, or to be the subject of infringing activity, that is to be removed or disabled, with information reasonably sufficient for us to locate it. Examples are the exact URL of an item in the public gallery or a shared project;
(d) your name, postal address, telephone number and email address;
(e) a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and
(f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2.2 Singapore notices. If you want your notice to be treated as a notice under the network service provider provisions of the Singapore Copyright Act 2021, it must also be in the form, and contain the information and statements, prescribed by the Copyright Regulations 2021. If we offer a notice form for this purpose, you may use it.
2.3 EU notices. For SuperX AI, a notice that contains the elements in Section 2.1 also meets the requirements of Article 16 of the DSA. Our decision, the statement of reasons and your right to complain follow the SuperX AI Content and Community Policy.
2.4 Before you send a notice. Please consider whether the use may be permitted, for example under a license, as fair use under US law, or as a permitted use (including fair use) under the Singapore Copyright Act 2021.
2.5 Incomplete notices. If a notice does not substantially comply with Section 2.1 but does identify the work, the material and how to contact you, we will promptly try to contact you to obtain what is missing. Otherwise we may be unable to act on it.
2.6 Language and format. Notices must be in English or come with an English translation. We accept bulk or automated notices only in a format we have agreed with the sender.
3. How we respond: SuperX AI
3.1 When we receive a complete notice about content stored or published on SuperX AI, we act expeditiously to remove it or disable access to it, unless the notice is manifestly unfounded (Section 9.2). This covers, for example, posts in the public gallery, shared canvases and projects, reusable prompts, workflows and similar items, and stored Outputs. We also take reasonable steps to notify the user who posted it. We give that user a copy or summary of the notice, which may include your name and the contact details you provided.
3.2 We may also remove clones and remixes made from the material.
3.3 For SuperX AI, decisions under this Policy come with a statement of reasons and can be challenged through the complaint process in the Content and Community Policy.
3.4 We may also act without a notice when we become aware of infringing content. We may act under our other terms whether or not a counter-notice is sent.
5. Counter-notices
5.1 Sending a counter-notice. If your material was removed or disabled and you believe this was the result of a mistake or misidentification, you may send a counter-notice to copyright@superx.sg. It must include:
(a) your physical or electronic signature;
(b) identification of the material that was removed or disabled, and where it appeared before it was removed or disabled;
(c) a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
(d) your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which SuperX may be found), and that you will accept service of process from the person who sent the original notice or that person’s agent.
5.2 Singapore counter-notices. If the original notice was made under the Singapore Copyright Act 2021, your counter-notice must be in the form, and contain the information, prescribed by the Copyright Regulations 2021.
5.3 What happens next. We promptly send a copy of your counter-notice, which may include your personal details, to the person who sent the original notice. We tell them that we will restore the material, or stop disabling access to it, in 10 business days. Unless our designated agent first receives notice that the complainant has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material, we then restore it no less than 10 and no more than 14 business days after we receive your counter-notice. Where Singapore law applies, we follow the counter-notice process under the Copyright Act 2021 and the Copyright Regulations 2021.
5.4 We may decline to restore material that we decide breaches our terms or the law for other reasons. SuperX AI users may also use the complaint process in the Content and Community Policy.
6. Repeat infringers
6.1 In appropriate circumstances we terminate the accounts of users and customers who are repeat infringers, as required by 17 U.S.C. §512(i), and we take similar action under other applicable laws.
6.2 We record a strike when material is removed or disabled in response to a valid notice and is not restored after a counter-notice. Three strikes within 12 months lead to termination. We count strikes across all accounts controlled by the same person or organization.
6.3 We may terminate an account after fewer strikes, or after a single notice, for serious or willful infringement. Examples include cases where a court has found the user to be an infringer.
6.4 A strike is removed if the material is restored after a counter-notice, the notice is withdrawn, or we determine that the notice was invalid.
6.5 Users and customers whose accounts are terminated under this Section must not open new accounts.
7. Trademarks and other intellectual property
7.1 Trademarks. Send trademark complaints to copyright@superx.sg. Please include:
-
your name and contact details;
-
the trademark, with registration details (jurisdiction, registration number and goods or services) or the basis of any unregistered rights;
-
the location of the content complained of;
-
an explanation of why the use infringes, for example because it is likely to cause confusion or concerns counterfeit goods;
-
a good-faith statement and a statement that the information is accurate; and
-
your signature.
7.2 Other rights. You may also send complaints about design rights, patents, trade secrets, database rights, passing off or rights of publicity or personality to copyright@superx.sg. We will review them and act as appropriate. Some disputes, such as those about patents, need a court or tribunal to resolve. In those cases we may refer the parties to each other or to the courts.
7.3 Intimate images and impersonation. Requests about intimate images, deepfakes or impersonation go to abuse@superx.sg under the SuperX AI Content and Community Policy. That Policy includes removal of intimate images within 48 hours of a valid request.
7.4 We may share your complaint, including your name and contact details, with the affected user or customer.
8. AI models and Outputs
8.1 Outputs are generated by AI models at the direction of users. SuperX does not review Outputs before they are generated. Users are responsible for how they use Outputs, as set out in the Master Agreement.
8.2 Notices about Outputs stored or published on SuperX AI are handled under Sections 2 to 6 in the same way as other content.
8.3 Outputs are not unique, and different users can obtain similar Outputs independently. A notice about an Output should explain how it reproduces protected expression from your work. Similarity of style, idea or subject matter alone is generally not infringement.
8.4 If you believe that an AI model reproduces your work, or was trained on your works without permission, write to copyright@superx.sg. SuperX does not develop or train the third-party models offered through the Services. We will forward your complaint to the model provider identified in the SuperX AI Model Terms and Provider Disclosures (https://aicloud.superx.sg/terms). Where appropriate, we may apply filters, restrict the model for the prompts concerned or suspend its availability. You may also contact the model developer directly. This includes exercising any text-and-data-mining opt-out available to you, such as a reservation of rights under Article 4(3) of the EU Directive on Copyright in the Digital Single Market (Directive (EU) 2019/790).
8.5 SuperX does not use content submitted to SuperX AI to train AI models without the user’s opt-in (see the Master Agreement).
9. Misuse and bad-faith notices
9.1 Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees. False statements in notices or counter-notices may also create liability under other laws, including criminal liability in some jurisdictions.
9.2 We may reject notices that are incomplete or manifestly unfounded, or that are used to harass, to silence legitimate criticism or to gain a competitive advantage. For SuperX AI, after a warning, we may suspend the processing of notices from people who frequently submit manifestly unfounded notices (DSA Article 23; Content and Community Policy, Section 8.6). We may terminate the accounts of users who abuse this process.
9.3 Senders of bulk or automated notices are responsible for their accuracy. We may ask for confirmation that a person has reviewed them.
10. Transparency and use of information in notices
10.1 We may share notices and counter-notices, including the names and contact details they contain, with the affected user or customer and, for counter-notices, with the person who sent the original notice.
10.2 We may share notices, with personal contact details removed, with organizations that collect takedown notices for research and transparency. We may also include statistics in our transparency reports.
10.3 We process personal data in notices in line with our privacy policies: https://aicloud.superx.sg/privacy.
11. No legal advice and other matters
11.1 This Policy is not legal advice. If you are unsure whether material infringes your rights, or whether your own use is permitted, consult a lawyer.
11.2 SuperX does not decide intellectual property disputes between other people. Removing or restoring material is not a decision on the merits.
11.3 Nothing in this Policy limits SuperX’s rights or remedies under the Master Agreement or the law. Nor does it create obligations for SuperX beyond those the law imposes. We may update this Policy under the change provisions of the Master Agreement.
12. Contact

Feedback does not include your confidential User Content.
13. Indemnity
Terms of Use
23. Indemnification
If you are a Business User, you agree to indemnify, defend, and hold harmless SuperX, its affiliates, directors, officers, employees, agents, licensors, and service providers from all claims, demands, investigations, and proceedings brought by third parties (including regulatory authorities), and all related losses, liabilities, damages, fines, penalties, costs, and reasonable legal fees, arising from:
-
Your violation of these Terms, the Content and Community Policy, the Export Compliance Terms, or the Provider Terms;
-
Your unlawful use of the Services;
-
Your User Content;
-
Your infringement of third-party rights;
-
Your violation of applicable law;
-
Your misuse of API keys or account credentials.
This indemnification obligation does not apply to the extent that a claim results from SuperX's breach of these Terms, negligence, or wilful misconduct. We will notify you promptly of any claim, and you must not settle a claim in a way that imposes obligations on SuperX without our prior written consent. If you are a consumer, you are responsible for such claims and losses only to the extent permitted by the law of your country of residence and only where they result from your breach of these Terms or your unlawful conduct.
14. Disclaimers
Terms of Use
21. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
To the extent permitted by law, SuperX disclaims warranties, representations, and conditions not expressly stated in these Terms, including implied warranties of:
-
Merchantability;
-
Fitness for a particular purpose;
-
Non-infringement;
-
Accuracy;
-
Availability;
-
Reliability.
We do not warrant that:
-
AI outputs will be accurate;
-
AI outputs will be unique;
-
AI outputs will be suitable for your purpose;
-
The Services will always be available;
-
The Services will be free of errors or vulnerabilities;
-
Third-party AI models will remain available;
-
Generated Content will receive intellectual property protection.
Nothing in this Section excludes or limits any warranty, guarantee, or right that cannot lawfully be excluded, including the statutory rights of consumers (for example, the right to digital services that conform to the contract), or any express service-level commitment in a written agreement signed by SuperX.
15. Limitation of Liability
Terms of Use
22. Limitation of Liability
To the fullest extent permitted by applicable law, neither SuperX nor its affiliates, directors, officers, employees, agents, licensors, or service providers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising out of or related to these Terms or your use of the Services.
To the fullest extent permitted by applicable law, SuperX's aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:
-
The fees you paid to SuperX for the Services giving rise to the claim during the 12 months preceding the event giving rise to the claim; and
-
USD 100.
The exclusions and limitations in this Section do not apply to SuperX's liability for: (a) fraud, fraudulent misrepresentation, or wilful misconduct; (b) death or personal injury caused by negligence; or (c) any other liability that cannot be excluded or limited under applicable law. This Section does not limit your liability to SuperX, including your obligation to pay for the Services and your indemnification obligations.
Consumers. If you are a consumer, the exclusions and limitations in this Section apply only to the extent permitted by the law of your country of residence. If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for loss that was not foreseeable when you accepted these Terms, and we are not liable to you for any business losses.
16. Governing Law
Terms of Use
30. Governing Law
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by and construed in accordance with the laws of the Republic of Singapore, without regard to conflict-of-law principles.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, and nothing in these Terms limits any mandatory consumer protection or other rights that cannot legally be waived in your jurisdiction.
17. Dispute Resolution and Arbitration
Terms of Use
31. Dispute Resolution
You and SuperX will first try to resolve any dispute, controversy, or claim arising out of or relating to these Terms or the Services, including their existence, validity, interpretation, performance, breach, or termination (a “Dispute”), through good-faith negotiation for 30 days after either party notifies the other of the Dispute; notices to SuperX must be sent to legal@superx.sg. Any Dispute that is not resolved in that period shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre (“SIAC”) in accordance with the SIAC Rules in force when the arbitration is commenced.
In any arbitration:
-
Seat of arbitration: Singapore;
-
Number of arbitrators: One;
-
Language: English;
-
Confidentiality: the arbitration and its outcome are confidential, except as needed to enforce an award or as required by law;
-
Hearings: hearings may be held by video conference.
Nothing in this Section prevents either party from seeking interim or injunctive relief from any court of competent jurisdiction, or prevents SuperX from bringing proceedings for unpaid amounts in any court of competent jurisdiction.
Consumers. The arbitration agreement in this Section does not apply to you if you are a consumer habitually resident in the European Union, the European Economic Area, or the United Kingdom, or in any other jurisdiction whose law does not permit binding pre-dispute arbitration agreements with consumers. You may instead bring proceedings in the courts of your place of residence, and you keep all mandatory rights under your local law. Any other consumer may choose to bring an individual claim in a small-claims court with jurisdiction instead of arbitration.
Individual claims only. To the extent permitted by applicable law, Disputes will be resolved only on an individual basis. Neither you nor SuperX may bring a claim as a plaintiff or class member in any class, collective, consolidated, or representative action or arbitration.

32. Miscellaneous
Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver
Failure to enforce any provision does not constitute a waiver of that provision or any other provision.
Assignment
We may assign or transfer our rights and obligations under these Terms to a member of the SuperX Group or to a successor in connection with a merger, acquisition, restructuring, sale of assets, or other corporate transaction, on notice to you, provided that this does not reduce your rights under these Terms.
You may not assign your rights or obligations without our prior written consent, except where permitted by applicable law.
Entire Agreement and Precedence
These Terms, together with the Additional Terms, constitute the entire agreement between you and SuperX concerning the Services and supersede any prior agreement on that subject, but nothing in this Section limits liability for fraud or fraudulent misrepresentation.
If these documents conflict, the following order of precedence applies:
-
A written agreement signed by SuperX, such as an enterprise agreement or order form, prevails over these Terms to the extent it expressly says so;
-
These Terms prevail over the Additional Terms, except that the Creator License Agreement prevails for content submitted to the Creator Program, the DPA prevails for the processing of personal data on a Business User's behalf, and the more restrictive Provider Terms apply as described in Section 5.1; and
-
The Content and Community Policy and the Export Compliance Terms always apply and prevail over any conflicting provision of any other document, including an enterprise agreement, unless that agreement expressly identifies the provision it varies and is signed by an authorized signatory of SuperX.
No Agency
Nothing in these Terms creates a partnership, joint venture, employment, fiduciary, or agency relationship between you and SuperX.
Third-Party Rights
Except for members of the SuperX Group, the persons entitled to be indemnified under Section 23, and any Model Provider that the Model Terms identify as a third-party beneficiary (to the extent described there), a person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of these Terms.
Notices
We may send you notices by email to the address associated with your account, through the Services, or, for notices of general application, by posting them in the Services. You must send legal notices to SuperX by email to legal@superx.sg. You agree that these Terms, notices, and other communications may be provided and accepted electronically, and that your electronic acceptance of these Terms has the same effect as a signature, including under the Electronic Transactions Act 2010 of Singapore.
Language
These Terms are written in English. Any translation is provided for convenience only, and the English version prevails if there is a conflict, except where the law requires otherwise.
